Salih Mustafa's defence is expected to stay in Kosovo from mid-March 5th with the goal of collecting evidence to face in court, where former commander The KLA is being accused of committing war crimes. At today's conference on the Mustafa case, held in The Hague Specialised Chambers, the prosecution announced it is ready for the start of the trial process, while the judge said that the passage of the court's case file is expected to take place on 30 April.
At the conclusion of today's session, the trial of the preliminary procedure, Nicolas Guillou, has indicated the order that the protection of Salih Mustaf must hand over the preliminary file by 16 April.
Until April 16th, Friday, the defence is invited to hand over the preliminary file and related material, according to rule 95/5. Being the object of solving any remaining problems, passing the court case file is expected to occur on 30 April”, he said.
While on April 6th, the defence has been ordered to hand over any request for protection measures for witnesses, alibi, and not alibi.
And Mustafa's lawyer, Julius Von Bone, has not seen the right thing to do with their activities.
I'd suggest we postpone this deadline further in time, but before the schedule for the preliminary file, if I did, I'd like to ask to postpone it on April 16th, since it's about the preliminary file, if we can get past it by the 30th, I've seen you propose by the 30th pass of the court file, I think that during that month we'll be able to complete most of this file. I think for the sake of efficiency and preparation of our preliminary file, it would be more useful to push”, he said.
He also indicated that he will remain in Kosovo between mid-March and 5 April to conduct investigations.
While, the Specialised Prosecutor's Office has stated it has completed the extraction of evidence in the case and that they do not plan to issue new evidence unless such can be released from investigative activities.
The prosecutor has said the excusing evidence has made it available to the defense.
“The ZPS has completed its investigation, there are only two still completed investigative activities, we discussed the private session and deposited a document protocol this morning, you are fully informed of this. An unfinished investigative activity is fully aware of your knowledge, sir. These two activities do not prevent readiness to pass the case in the judicial process at all, we are willing to start the” judicial process, he said.
The Mustafa Act was confirmed on June 12, 2020, and the same was arrested on 24 days since being held in custody at The Hague.
Before the Specialised Chambers, Mustafa had been declared innocent over charges under war crimes claims.
