Charged for involvement in terrorist groups in Syria protected in silence

Otherwise, material evidence was administered at the beginning of this session, four of which were opposed by the defender of accused Sylejmani, lawyer Asdren Bytyqi.

This opposition was partially approved by the chairman of the court, Judge Valon Kurtaj.

“partially approved defence opposition. Hamza Hyseni has also witnessed as a witness and co-incoherent. The statements he has given as a defendant will not be administered as evidence, while those as witnesses will be administered as witnesses for the fact that it is not the only evidence”, Kurtaj said.

Regarding the transcripts of phone conversations, Prosecutor Fikrije Fejzullahu has proposed to the court not to be administered as evidence, which the proposal was approved by Judge Kurtaj.

Prosecutor Feyzullahu has also made the upgrade of the test photos that had originally been found to be provided by the FBI.

Also, Judge Kurtaj has rejected the defence request, under which the case the defendant Sylejman is charged with is a trial case.

“From the actual description to the accusation act which is the subject of consideration in this criminal case and in the accusation act is not the same criminal act and the same actual description. The defense has also stated this claim in the request for the cast and accuser's action and where the first-instance court has rejected this proposal in the case of deciding on this requirement, and the same verdict has remained in force under the appeal court's decision, and the Court of Appeals has reviewed the defence complaint with the apparent complaint where complaints were rejected and the first degree ruling has remained in force”, Kurtaj added.

According to the indictment, filed on August 5, 2020, by the Special Prosecutor of the Republic of Kosovo, defendant Nuredin Sylejmani, with the aim of joining terrorist organisations in March 2013, deliberately and consciously fled from Kosovo to Istanbul in Turkey along with suspect Hamza Hyseni, who is on the run as well as several others.

The same, according to the indictment, had gone to the city of Idlib in Syria, where they had met with other Albanians and all had begun military exercises in order to return to fighting under the terrorist organisation Al Nusra, which, as noted in the indictment, was known as “I SIS” and was declared a terrorist organization by the United Nations organization.

Always according to the indictment, on March 23, 2013 the accused had returned to Kosovo, while all travel expenses for himself and others were covered by the accused himself.

With this, P The SRK charges Sylejmani to have committed criminal work “organization and participation in terrorist group” by Article 143, paragraph 2 of the Republic of Kosovo Criminal Code.

Otherwise, Sylejmani was sentenced to six years in prison and 1800 euros in fine for illegal weapons and for assaulting two American citizens in another case where he was accused by P. SRK. This sentence pronounced by the Constitutional Court in Pristina had been confirmed by the Court of Appeals.

In the same case, Sylejman was also accused of facilitating the acts of terrorist, but after he was first acquitted of this charge from the first instance, the case was turned into a retrial by Apelli following the SPRK's complaint.
