Base attorney and prosecutor's suspension required in Sebahate Sopi case

Both of these organisations have reacted to the neglect that they claim the Founding Prosecutor in Pristina and Kosovo Police in the Sebahate Sopi case.

On March 14th, L.S. allegedly in Pristina's “Emshire” neighbourhood has originally killed his wife Sebahate Sopi, and then killed himself.

IKD and ( The RKK, have published preliminary findings in the investigation into Sebahate Sopi's murder case: “The state with no action, it cuts off Sebahate Sopin”.

Ehat Miftaraj from the IKD said that by constitution the right to life is essential and should be guaranteed by the state, but that such a thing has not been ignored in Sopi's case.

 The foundation procedure in Pristina has failed to exercise its competencies and duties to offer protection in this case to victim Sebahate Sopi. What was even more felt was the fact that the Founding Prosecutor in Pristina yesterday sent a communiqué to the media through which unfortunately he tried amateurally and by no means human to flee responsibility and publicly lie that this prosecutor has undertaken all actions in this case”, He stressed.

He has announced that the deceased was the victim of domestic violence in 2019, and as a result, there was a warrant issued by the Constitutional Court in Gjilan. The order for protection had expired in 2020. Sebahate Sop's daughter on March 3rd had reported domestic violence against her mother. Miftaraj stressed that the state prosecutor with only one interview was enough not to take additional action.

 “State Prosecutors in the Republic of Kosovo must realise that the prosecutor's position is not the privilege of receiving around 20 thousand euros, 30,000 euros, up to 60 thousand euros a month, which some prosecutors receive. But the prosecutor's position is accountable to the constitution, responsible to the law, is the responsibility to report to the prosecutorial system and citizens. Unfortunately today, state prosecutors are exploiting privileges, but are not exercising their responsibilities to the constitution and law”, he added.

And, Adelain Berisha from the Kosovo Women's Network stressed that women for years are reporting violence, but that responsible institutions are refusing to offer support, resulting in the outcome of life with fatality.

“We will demand that prosecutors be found who, we know, are also others who are not doing their jobs and duty properly. And we will ask for their dismissal and other measures which are punishable for these task advisers in official institutions”, She said.

IKD researcher Shala added that the state prosecutor in yesterday's communiqué, trying to cover his guilt, has testified to the obvious negligence.

“Foundation Procurory in Pristina except that there has been a case filed, there has been criminal evidence that the same for violence against the same has been held in custody and there has been an order of defender. It's systematic violence over the years and that the risk of the explosion has been available, right away. Despite that, however, the prosecution has taken no action within its competencies. If the prosecution were to take action within its competencies, the rationality is believed to have taken the distance between the arm and the victim”, He added it.

He has added that the responsible institutions have violated Sebahate Sopi's right to life.

 “The IKD and RGK are asking the prosecutorial system to urgently address the aspect of accountability in this case. And the first aspect that it takes is to suspend chief prosecutor of the Constitutional Prosecutorship in Pristina, Cameron Munich and the prosecutor of this case. And we also want to form a working group to whiteen this case”, He's done.

According to Shala, this working group should be represented by a prosecutor who is not from the Founding in Pristina, a representative of the victim and two representatives of civil society.

The Pristina Constitutional Prosecutor's Community reportedly has invited to police on 4 March for additional statements Sebahate Sopin, but the same has not been submitted to the Police Station.

The same was allegedly killed by her husband on March 14th, the same man killed himself.
