Association challenge even for incoming government, EU urges its establishment

Meanwhile, by the Vetevendosje Movement, as the winning party in the February 14th elections, they have refused to respond to their approach to the subject, while political connoisseurs voiced determination that association should be formed, but only under the constitutional decision.

EU spokesman Peter Stano says the Constitutional Court's act on association is being misinterpreted in Kosovo, according to him, the same has never said that association cannot be founded.

However, he has not indicated whether this topic will be opened since the first meeting of the dialogue is resumed.

Kosovo entered an agreement to establish the Association of Serbian municipalities. This agreement was concluded with confidence by all parties involved. He's never retired. In fact, the 2013 agreement was ratified by the Assembly of Kosovo with a majority of 2/3. By doing so, Kosovo undertook an international obligation to implement this agreement. The constitutional court ruling in 2015 regarding the association is constantly misinterpreted. The court has never said that association cannot be founded. Therefore, we expect Kosovo to honour the commitments it has undertaken in the Dialog”, he says of KosovaPress.

The association, according to Arton Demhaye from Arise, can be established, but only under the Constitutional Court's justice.

He puts it a category against the Association being established under the 2013 Brussels Agreement.

For as long as this Constitution that we have remains in force and does not change. No one can and cannot create an association that relates to the Brussels agreement and conflicts with the Constitutional Court's ruling. The decision is mandatory and no one can oppose that decision to create a statute of association that conflicts with that decision and our Constitution. So it can be allowed to form the Association of Serb majority municipalities, but which is in line with the Constitutional Court's decision and Constitution, only on something like that is acceptable. But not in the application and corruption of the Brussels agreement that has turned out to violate very much the principles of our Constitution”, he says.

While Albert Krasniqi from Democracy Plus says the Association statute should also be sent in advance to the Constitution for interpretation.

The new statute toʹi is also required to be sent in advance to the court for interpretation. So that association should be done only as the Constitution has determined and in no other way ...the association could have taken place the next day the Court has released that interpretation. But be done on the basis of the bias and not on the basis of the agreement, which was signed in Brussels for association”, he says.

Because of the topic of association last year, Kosovo-Serbia dialogue was blocked. This, in the wake of the Serbian side's request for its establishment and the basic rejection of Kosovo institutions, so that the same could be formed outside the Constitutional Court's conviction.
