At the hearing session at the Lucerni Criminal Court in September 2020, the prosecutor had asked for him 18 months in prison on bail for the criminal act of physical assault, with a three-year trial period. In addition, the accused Kosovar had to be expelled from the country for twelve years.
The private plaintiff has also demanded compensation and compensation for the loss of 90,000 francs in favour of the victim.
However, the accused views himself as a victim and demands innocence.
Ten Years of Exile
The trial of the criminal court is now available. This judgment views the accused, not as a victim, but as perpetrators of criminal acts.
Thus, the court in question has sentenced the 27-year-old to 23 months in prison on bail with a trial period of two years and ten years of expulsion from the country, broadcasts albinfo.ch. This expulsion includes its introduction into the Schengen area's information system.
It should also pay judicial and procedural expenses, as well as compensate the private plaintiff of 11,000 francs.
In its ruling, the court writes that the accused should compensate the victim for 100 per cent of the damage caused. But for this, the victim must refer to civil judges to determine the corresponding amount of damage.
The defense attorney, on the other hand, sees no cause link between the victim's inability to work and the fight. According to him, it is the victim's present state of health.
But the Criminal Court opposes that. For this reason, the Cantonal Court must re-judge the case.
