The Constitutional Court in Prizren has approved Prizren's Constitutional Prosecutor's request for the appointment of detention action against defendants B.M., because of the suspicion that he committed domestic violence criminal acts.

Procedure Judge Fidan Hoxha, the state prosecutor's request for the appointment of the detention measure against the defendants, has approved it as based, and the same has been assigned the detention measure in length of 15.15 days.

The defendant B. M on February 10th, in the evening hours of the common house, with the intent of violating dignity within a family relationship, causes violence and psychological abuse of the injured (all members of the family), so that the defendant goes home in a drunken state of 2,55 promil in blood, enters the living room where all members of the family were present and starts shouting at the same person, as well as the defendant addresses the injured, his son's saying that this is not your home and brings you out, in case of injury and fears of the police.

The court, deciding on the request for detention, took into account other alternative measures, but the court found that the detention measure in the concrete case as well as this phase of the criminal procedure is necessary and reasonable to prevent the risk of repeating other criminal acts, as well as the possibility of changing the evidence of such criminal acts described as higher in order to avoid criminal responsibility. Therefore, the appointment of any other measure at present would be contrary to the nature of investigations and the prevention of other criminal acts.
