President or prime minister? Who should first be elected by Enver Hasani

Former head of the Constitutional Court, Enver Hasani, is saying political parties in the country should initially proceed with the election of first Republic before the prime minister, since, according to him, the leader of the president's office cannot mandate anyone to create the new government. However, there have been previous practices. Jakup Krasniqi, from the quality of the president's task leader, had mandated Hashim Thaci to prime minister. And such a Krasniqi decision, according to the former Constitutional head, had been a mistake and had never been challenged at the Court.

The former head of the Constitutional Court, Enver Hasani, is saying that after the February 14th elections, the election of leaders of three state institutions should begin from the Parliament of Kosovo, the Presidency and finally the Government.

The rotation of key members of power represented by the respective bodies of power in a modern constitution speaks a lot about the character of the political and constitutional system. In Kosovo this ranking starts with the legislature and representatives (Kosovo Assembly), continues with the head of state (President of the Republic), which is followed by executive (Kosovo government)”, Hasani has said of Koha.net.

However, in the practices pursued over the years by the institutions of the Republic of Kosovo, it had occurred that a leader's task was to nominate a candidate for prime minister.

He had done so, Jakup Krasniqi, on February 18, 2011, at the time in the quality of the president's task counsel had nominated Hashim Thaci for creating the new government.

Krasniqi had done so by being called to Article 90, Article 84 points 14 and at Article 95 paragraph 1 of the Constitution of the Republic of Kosovo, as well as in the ruling number 231-2011 of the Central Election Commission's 7 years of election certificate.
