Miftarian: Constitutional Court Paradox Pal Lekaj has been convicted today but can be certified as MP

Ehat Miftaraj from the Kosovo Institute for Justice (IKD) has reacted after the condition sentence of the two officials -- one from the PDK and one from the AAK -- as the emphasis on illustration of the Constitutional Court's decision has put it to the latter. “P.S. Concerning the decision of Constitutional Court, Paul Lekaj if he has received enough votes [...]

“P.S. In the face of Constitutional Court's decision, Paul Lekaj, if he has received enough votes in the February 14th elections, 2021, could and would be certified as deputy of the Kosovo Assembly. The Constitutional Court Paradox, right?

He has made these comments while criticising the courts for failing to bring an effective prison sentence on the two officials, among whom is the deputy candidate from the AAKA ranks, Paul Lekaj.

The latter has been convicted of misusing official office during the time it was serving as head of the Gjakova municipality, on charges of subsidy fraud and leaving the tax.

The Constitutional Court, following last year's public hearing for the vote by former President Eem Arifaj, has asked the CEC to refer to the Law on General Elections for terminating candidates for MPs. In the respective law, people who have a problem with law in the past three years have no right to run for deputy.

Full Posting:

Today, basic courts convicted two senior public officials of corrupt criminal acts, one from the PDK and the other from the AAK.

In both cases, courts pronounced parole sentences. The courts had no courage and courage to declare sentences to effective prison terms.

The Penal Code, Criminal Procedure Code, Supreme Court Guide over Kosovo's penal policy, is not respected and implemented by judges in high profile cases.

However, positive from these cases is the fact that in no court session did they ask for forgiveness from convicted people, at least not publicly.

P.S. In the face of Constitutional Court's decision, Paul Lekaj, if he has received enough votes in the February 14th elections, 2021, could and would be certified as deputy of the Kosovo Assembly.
