The Appeals Court has confirmed the new indictment filed by the Special Prosecution of the Republic of Kosovo (PSRK) against the accused in the “People's Office, Avni Llumnica, Sadri Ramabaja and Bajrush Konjusha case.
In the ruling, which has provided “Justice Voilour”, it is said that the Court of Appeals, on February 1, 2021, has rejected the complaints of defenders of the accused Llumnica and Ramabaja, lawyers Naim Rudari and Ramiz Krasniqi as groundless.
Initially, the Constitutional Court in Pristina, with its ruling issued on January 18th, 2021, had refused as groundless the demands of defence for dropping the indictment and rejecting evidence.
After returning to zero point of this case, The PSRK had presented a new indictment, where only Sadri Ramabaya, Avni Llumnica and Bajrush Konjusha were now charged.
Llumnica is accused of attempted murder of Azem Vlads in co-ordination with Murat Jasharin, who is not part of the indictment, as due to his state of health, the court has pronounced to him the extent of compulsory psychiatric treatment.
While Ramaba is accused of helping the accused commit the criminal act of attempted murder.
P The SRK has also left in the accusatory act Bajrush Konjusha, who charges him with illegal weapons-taking criminal acts, which after admitting guilt was sentenced to 300 euros in fines.
Appeals' decision states that the defenders' complaints were not based on the reasoning that the first-instance court had correctly assessed the demands submitted by defenders for dropping the charge.
Reason given by the first degree, according to Appeals, contains sufficient reasons that the new indictment set up by P The SRK proves that there is sufficient evidence to support the well-founded suspicion that the accused have performed the deeds they were charged with.
According to Apel's assessment, the first degree has extended the reason for the suspicion based on controversial evidence and has correctly proved that sufficient legal-procedure evidence exists.
The appeal in her decision has estimated that, based on the evidence found in the subject papers and actions described in the indictment, there are now the primary elements of criminal acts accused of.
Otherwise, this case is known as “The People's Office” had begun under the Special Prosecutor's Act of the Republic of Kosovo (PSRK), on February 27, 2018.

According to the indictment, this group with the intention of killing those whom they considered to be traitors had founded the “Freedom of the Homeland” and as the organisation “The People's Office” had a structure divided under the hierarchy, had coded names and various tasks are said among the other in the indictment.
While, defendant Murat Jashar is said to have attempted to kill Azem Vlasi as a former official who, according to them, was named first on the country's traitor list.
In this, they were accused of committing criminal work “preparing terrorist or criminal acts against the constitutional order and security of the Republic of Kosovo” by Article 144 I KPRK's.
The defendant Bajrush Konjusha was also charged with criminal activity “ownership control, or unauthorized possession of weapons “since a gas pistol and a 250-sharp air rifle had been confiscated in his house.
While, Murat Jashari of the PSRK was charged with criminal acts “taking revenge” and “maintaining ownership, controlling or unauthorized possession of weapons”.
The prosecution accused Jashar of being able to understand and control his actions because of the skisoftible-manic, permanent-type disorder on March 13, 2017, he went to the residence of the injured Azem Vlasi in Pristina to deprive him of his life as former senior leader of LKJ and former Kosovo leader, considering the same as traitor because of his stand with demonstrations of 191 and the national case.

Furthermore, the prosecution claims that Vlase has seized the gun from Jashar and is seated, which has influenced the bullet to hit Vlad on the left of his chest, causing serious bodily injury. After that, Jashar had once again attempted to shoot the victim, but Jashar had been blocked and then fled from the scene, to meet with defendant Avni Llumnica, to be arrested by police at motel “Fontana”, Veternik.
According to the indictment, after police had made a search at motel “The Fontana”, at Jashari, was found and confiscated a type “Crvena Zastava”, 70-65 mm calibration model, deafer, and a 7-shooter, which he used without permission.
According to this indictment, the Constitutional Court in Pristina, led by the chairman of the panel, Naim Krasniqi adhuroni Jashanica and Judge Vesel Ismajli and Valbona Musliu Selimaj, had received the conviction which the accused had found guilty.
Sadri Ramabaja, Murat Jashari, Ragip Salova, Avni Llumnica, Bexhet Luzha, Halim Halimi, Bajrush Konjusha and Rexhep Toplana were convicted of criminal acts against constitutional order and other criminal acts in January 2020.

But with the findings of the Constitutional Court, the Court of Appeals, which had turned the case into retrial, had even demanded that the case return from the initial review due to inevitable violations.
Apel's decision states that “criminal case turns into restoration to be processed by initial consideration and following the regulation of the indictment act”.
This decision had led the Special Prosecutor to present a new indictment with many changes after several months.
According to the indictment of October 27, 2020, Sadri Ramabaja, Avni Llumnica and Bajrush Konjusha are the only ones charged in this case.
This is because the SPRK renounces criminal acts against constitutional order, respectively, of doubt of the existence of a criminal group “People's Eye”.
The new Llumnica indictment charges that, in co-ordination with Murat Yasar, they had attempted to deprive themselves of life, Azem Vlass.
Ramaba is accused of helping Llumnica and Jashara carry out the assassinations against the injured Azem Vlasi, meanwhile Bajrush Konjusha is accused of the criminal act of armed maintenance.
