Father and son are sentenced to 34 years in prison for the murder of Marmula, Gjakova

The Constitutional Court in Gjakova on Tuesday has found father and son Prek and Alfred Hunting guilty.
According to the indictment, Alfred Djurdja is accused of killing the late Tune Bezhi, attempted murder of injured Anton Nicolaus and illegal weapons. And Prek Djuja is being accused of helping him commit a criminal murder.
According to the trial pronounced by the chairman of the court, Judge Mentor Bajraktari, accused Alfred Djuja of criminal murder has been sentenced to 18 years in prison.
The court, however, has requalified him in the criminal offence of serious bodily injury, and has sentenced him to 3 years and 6 months in prison, while for the illegal shooting criminal offence has been sentenced to 1 years and 6 months in prison.
Later, the same for these three criminal acts has been pronounced a unique prison sentence of 22 years.
While accused Prek Djuja for the criminal act of helping him commit the crime of murder has been sentenced to 12 years in prison.
The accused in pleading the sentence will also be counted as the time spent in custody, while Judge Bajraktari said that even for the accused, Prek Djuja is appointed by today's detention day.
The damaged parties have been instructed in civil disputes for the implementation of property legal requirements.
Otherwise, at the initial session held on December 11th 2019, accused Alfred Djuja had not been declared guilty, while accused Prek Djuja was declared innocent.
According to the act of Constitutional Prosecutor in Gjakova, founded on November 29, 2019, Alfred Djujja is charged that on March 12, 2019, around 18:35, in the village of Marmula of the Gjakova municipality, right next to Anton Nikolla's home, he has deliberately deprived the deceased Tune Bezhi of life now.
As reported in the indictment, the case occurred in the manner that after a property dispute, since now the deceased by Martin Djurda, the brother of the other defendant Prek Djuja, had bought a parcel of land for which the defendant's family had not agreed, the critical day at Anton Nikolla's home had gathered to discuss the issue now of the late Tuj, Zefe Kita, Leke Bezhi and Prek Djuja.
According to the indictment, after they failed to comply, leaving the defendant Prek Djuja calls indictees Alfred Djuja, who announces that they have not reached agreement, who later in the day's room takes the automatic rifle and after arriving at the scene, first shoots 12 bullets in the direction of the deceased vehicle, where he comes out of the vehicle for escape, the defendant shoots a bullet at the victim's victim, hitting the abdomin on the lower left side, with the feeling of lethal injuries.
For this, it is accused of committing criminal work “suicide” by Article 178 of KPRK.
The accused Alfred Djuja, according to the indictment, has deliberately attempted to deprive the life of the injured Anton Nicola, in a way that after shooting at the deceased man's vehicle Tune Bej described as the highest, injured Nicolaus in order to stop him from facing the defendants, and in that case, the same case, the same gun fired a bullet in his direction, hitting a left leg, and having injured him in the ground and attacked him, hitting him in the head with a rifle, and then the defendant leaves the scene in direction of the Rezin, following Tuna's call to return to the house of his police, where he has done his work with the police.
For this, it is accused of committing criminal work “attempted assassination” by Article 178-28 of KPRK.
The accused Alfred Djurdja, as writes in the Justice Vow, is also being charged with illegal possession of an unauthorized automatic rifle “typ 68” and 15 rounds of calibre 7,628335, respectively, which he used in the critical day.
While the other accused, Prek Djurda, is being charged with criminal work “in assisting in carrying out the criminal act of murder”, by Article 178, concerning KPRK's Article 33.
According to the indictment, on the critical day cited as the highest, he deliberately helps the other person -- the accused Alfred Djuja, respectively -- by creating conditions for performing the criminal murder -- so that the late man Tune Bezhi would not leave the scene, since the road was dead, his brand “vehicle.
