Vetevendosje's favorite director of Anti-Corruption Agency in conflict of interest (Documents)

Democracy. com has researched the candidates' profile for this position and found that Vetevendosje's man, Yll Buleskaj, since 2019, has been in conflict of interest, since the same has declared business in the ARBK and figures as the authorised “representative.

Article 15 of the Law No. 06/ L-011 for the Prevention of Conflict of Interest in Public Function Army, as Democracy has noted.com, defines:

 “1. The senior official cannot actively exercise the right to management and management at a company, despite the scope of its activity.

2. The high official, the owner of shares, or the share of capital in a company, during the exercise of public office, should transfer management rights or management, or direct company to any trusted person.

3. The senior official is obliged to transfer rights to the company's leader within the term of thirty days from the election, establishment or appointment to public office, transfer rights to the trusted person, and within the term of five (5) days of the transfer date of these rights to report the Agency in writing on the trusted person and evidence of transfer of management rights.

Similarly, Article 13 of this law has defined incompatibility with public office, where it points out that the senior official cannot be a manager, authorized representative or supervisor of a private legal body or supervisor, profitable under the law relevant to commercial societies and nongovernmental organisations, exempting subjects defined in Article 14 of this law, political subjects, and cases when such a function is legally dedicated to the function, says Democracy.

Bulletins who claim to run the Anti-Corruption Agency, which deals with and prevents conflict of interest, is in the state of the conflict of interest itself.

Currently, Buleskaj maintains the position of Director of the Central Election Commission and has declared his business, while in the Business Record Agency he figures as authorized representatives who object to the law, because he has not transferred management rights or management, or the direction of the company to any trusted person during the exercise of public office, as defined by Article 15 paragraphs 2.

The AKK's favorite Vetevendosje Movement for Directorship Yll Buleskaj appears to have no basic knowledge of this institution's mandate, ignoring legal obligations as senior official and violating them is still becoming director.

Failure to act on the Law's provisions No. 06/ L-011 for the Prevention of Conflict of Interest in Public Function Army, to avoid conflict situations of interest, constitutes criminal acts according to Article 417 of the Kosovo Criminal Code.

Whether the Kosovo Assembly will review the Commission's recommendation for Legislation before voting for the report with a recommendation for candidate vote is unknown.

Yll Buleskaj had become known before the February 14th elections, when it was being decided on Albin Kurti's election list of Vetevendosje.

The KDP had recommended to the CEC that criminal candidates not be certified as required by the law.

Among these names was the number one on the Vetevendosje Movement list, Albin Kurti. While, Buleskay from the Office for Registering Political Partys, contrary to the KDP's decision, insisted that candidates with criminal acts be certified.

This recommendation, Buleskaj justified saying they had no time to consider all cases. Buleskaj, with the support of the Vetvendosje Movement deputies, is currently the main contender for Anti-Corruption Agency Director.
