Spacilia continues detention measure Hysni Gucatit, Nasim Haradinaj

In the decision to continue detention for Haradinaj, the panel reportedly concludes that there is a danger that if released, the same could prevent the management of the procedure and commit criminal acts or repeat those criminal acts for which he is accused or he has threatened earlier.

According to the decision, the panel finds that the proposed regime is insufficient to ease the risks according to Article 41H6) çfarëb)ci-ciiti) of the Law regarding Haradinaj and that any additional conditions imposed by the panel will not influence that outcome.

“Sic was previously ascertained, is only through the framework of implementation communication monitoring in the detention facilities of Specialised Chambers that Mr. Haradinaj can be effectively controlled with the aim to ease the risks enough to prevent the KS procedures or commit further crimes”, the decision said.

On the other hand, the panel reportedly finds that the conditions listed in the proposed regime cannot sufficiently ease the risk of Haradinaj preventing procedures by distributing or facilitating the distribution of confidential or otherwise protected information and thereby threatening or influencing witnesses, victims or collaborators.

According to the decision, the panel finds that the proposed regime cannot ease enough the risk of Haradinaj committing criminal acts either in repeating what it was accused of, or which it earlier threatened to carry out.

On the other hand, the Gucatin panel reportedly concludes that there is a danger that if released, the Gucati could prevent the actual procedure and perform works or repeat what he was accused of or once threatened to carry out.

According to the decision, in view of the above findings on easing the risk of obstructing procedures, the panel finds that the proposed regime cannot suffice to ease the risk of Gucati committing violations in either the repetition of the works for which it is accused or that it has threatened earlier that it will carry out.

On the other hand, the panel reportedly finds that the proposed regime is insufficient to ease the risks according to Article 41л6) Whatib) of the Law regarding Gucati and that any additional conditions imposed by the panel will not influence that outcome.

Hysni Gucati, along with Nasim Haradinaj, is being charged with criminal acts against justice administration, specifically with obstructing official persons in carrying out official duties, fearing witnesses, taking revenge and violating the secret of the procedure, reports the “Justice Voughty”.

Gucati and Haradinaj are charged with making derogatory comments against potential witnesses and repeatedly expressed their intention to undermine the work of the Specialised Chambers, reports “Justice Vow”.

With these actions, Mr. Gucati and Mr. Haradinaj violated the secret of the procedure and feared witnesses (possibly) of the Specialised Prosecutor's Office and subsequently prevented the work and investigations of SPS.”, the Kosovo Specialised Chambers announced.
