Nasim Haradinaj's lawyer was infected with coronary: Special declines session delay request

The court has rejected Nasim Haradanaj's defence request, lawyer Toby Cadman, to postpone judicial procedures by Wednesday. Cadman's request was made after the same man said he was infected with Corleone and there are obstacles to communication with the accused.

At today's trial hearing in Specialised Chambers in The Hague, Cadman has said that by Wednesday even Nasim Haradinaj could be released from quarantine where he is staying because of the virus.

 I would ask to postpone the procedure for two more days, by Wednesday, so that my health situation improves and we hope that Mr. Haradinaj is out of quarantine, Mr. Berisha will be able to be present as well, and we want Mr Haradinaj to be present in court, we hope this is not an unreasonable request, and I want you to ask that you take this request seriously, and we cannot come under these circumstances if we ask for a very limited extension of”, the lawyer Cadman said.

That's what the Special Prosecutor's Office rejected.

 “Procuroria notes that in the Haradinaj case, we have two co-protectors who are available, one who is following him online and another who is present in court, co-aware who is in court is able to attend private hearings, so there is no excuse for the postponement of planned” sessions, prosecutor Valeria Bolic said.

In this case, Hysni Gucati's lawyer, Jonathan Elusan Rees, has suggested that all hearings be held open.

 If the main concern is the inability of Mr. Cadman and other people who are following us online to attend private hearings, we have a simple answer, that the entire session be organised or performed at the public session, so not at the private session. We predict that Mr. Gucatt's test should be heard at the public hearing and therefore we can continue to follow up on this base to”, attorney Rees said.

Although Rees has stated that the names he will mention during the hearings are public, the chairman of the court, Charles Smith, stressed the importance of keeping confidential information.

He has announced that the hearings will continue as planned, thus rejecting Haraidnaj's lawyer's request for postponement of procedures.

 Mr. Cadman, the Court does not accept your request for the following reasons, first it seems that you can communicate with your client through phone calls or through connections to the Bitzom, second, you can participate in these long distance sessions, this judicial body involved, and the administration office have the duty to ensure the safety and efficiency of judicial processes, one aspect of this duty is to ensure that confidential and non-public information is protected at all times. During the hearings we go to private sessions to protect such information, during private sessions the administration office must make sure that confidential information is not exposed by any means”, the chairman of the panel said.

Once again, he has asked lawyers to have questions asked during the trial only to be connected to the case in question.

Nasim Haradinaj's Hysni Gucati were arrested on 25 September 2020 and have since been held at The Hague's detention centre.
