Konjufca says Kurti Government does not want to keep up the decision on Decani Monastery

Parliament Speaker Glauk Konjufca has said the Constitutional Court's decision on the Decani Monastery should not be implemented.

He has stressed that the Constitutional Court judges, with the decision on the Decani Monastery, have not defended Kosovo's constitutionality.

I say it should not be implemented. I entered and studied the legal framework, not the Constitutional Court, but the legal framework of ownership and political decision when it was taken, and on which basis the Constitutional Court received it. My first dimension is scandalous, it is a 1997 decision by Slobodan Milosevic”.

I must be convinced, I've handled the subject myself. I think the Constitutional judges are there to protect Kosovo's constitutionality. I'm thinking in this case it's not protected. I think the judges have handled the case completely naked from its political-historic dimension”.

So what they've made of decision is reducing the problem to an administrative-cadastral issue. Issues of parcels taken in the time of the former Yugoslavia, that of Slobodan Milosevic. I think this case is like in court when an innocent man is convicted and that happens in every country in the world, it happens to be punished by an innocent man,” Conjufca said.

The prime minister has stressed that Kurti Government is the third one that has not been able to implement the decision on the Decani Monastery.

This is the third government that cannot implement that decision. I mean, in the sense of the government's own wish, it doesn't want that decision implemented. They're trying to give me an interpretation I belong to. The problem lies in the fact that the international community, important international factors, institutions and top representatives have a huge displacement in the context of this problem”.

So, for the most important international factors, they have access to the problem of vulnerability and the credibility of institutions, unless the state implements the decisions of its institutions most important. This in the formal state theory could be called a defective state, a state that is not functioning democraticly. Because he's chosen his own troops, they're making decisions, and then they're not being forwarded to the final constitutional co-ordination, that's the perspective of the international”.

I think not only as the concept of the Kurti Government and other institutional representatives of Kosovo, but I think of the Haradinaj government and the Avdullah Hot government as being the same denominator, the difficulty of making a decision to implement a Constitutional Court conclusion, which you yourself are instinctly convinced was failure or error”.
