Defence Seeks House Arrested by Hashim Thaci, Names Police and Third States Guarantees

The defence lawyer of former president of the Republic of Kosovo Hashim Thaci, Gregory W. Kehoe, in a long letter, listed arguments that, according to him, the Pre-Procedure Procedure Judge should consider releasing Hashim Thaci's home arrest. It cites guarantees provided by Kosovo Police and the guarantees of the Governments of the countries [...]
Kehoe has said there is no danger that his client will escape or make efforts to prevent the court's procedures, and also emphasises that there is no danger that Hashim Thaci “commits any other criminal work”.
Kehoe also as argument for the release of Thaci from custody uses the guarantee provided by Kosovo police.
“in any case, if required, Mr. Thaci confirms that he is willing to accept domestic arrest under any reasonable conditions that the Court of Pre-emptive Procedures finds necessary, including standard house arrest conditions to meet any request or concern of the Prosecutor and Court”, the defence requirement said.
Thaci's defence has also repeated, as an alternative, Thaci's release in a third state that has provided guarantees.
The defense repeats its proposal that Mr. Thaci will be released on [readed] territory, under conditions considered necessary by the Pre-emptive Procedure Court, in the implementation of Article 41 (11) and the Law and Rule of Specialised Chambers 56 (4) of the Rules. Such a move only because it has been successfully applied before other international courts for former senior officials and is fully justified in the current case”, the defence in the November 30th 2021 document emphasizes.
The defence also mentions the guarantee that this third state has issued to accommodate Hashim Thaci under the conditions required by the Pre-emptive Procedure Court.
The [read] government has confirmed Mr. Thaci in [readed] on a daily basis, in full compliance with the demands of Kosovo Special Chambers”, points to defence argument.
In the end, the defence says that the Court of Procedure should call the Kosovo Police hearings and representatives of third-nation Governments who have offered guarantees to keep Thaci under house arrest.
For these reasons, defence respectfully requires that the Court of Preemptive Procedure:
(i) call a hearing to listen
(a) Kosovo Police views on the feasibility of Mr. Thaci under house arrest at his house in Kosovo.
(b) The views of [readed] governments on Mr. Thaci in their respective territories;
(c) view of parties ;
(i) order the provisional release of Mr. Thaci, under such conditions as appropriate”, says in the letter of Thaci's chief lawyer sent to the Pre-emptive Procedure Court.
