KMLDNJ has said it is a mockery of the state of Kosovo by the Specialised Prosecutor that Kosovo Police cannot ensure the house arrest of those accused in Kosovo.

“So far, all requests for freedom protection or replacing the detention measure with a easier measure for the detainees, Kosovo citizens have been refused, in no way. The Special Court in The Hague is founded by the Assembly of Kosovo with a special Law, and at least it is estimated to be part of Kosovo's justice system formally, which is not denied either by the Special Court, especially when it has to make a serious decision for the detainees, now on confirmed charges”.

And so, KMLDNJ has said that in its composition, the Special Court does not have any citizens of Kosovo, of any ethnic affiliation living in Kosovo, it is neither hybrid (included composition), but it is 100% from foreign citizens who never happened before, is thus the case suigeneris.

The special court with a special mandate where the official side is 100% foreign, while the detainees are 100% Albanians, citizens of Kosovo, and from the aspect of human rights except that it is unfair, also makes up elements of a court that judges justice on the basis of ethnic belonging to the racist basis. There is no requirement that convinces the preliminary court to change its stated move, nor is the plea of defence attorneys, health and detention, nor the fact that for some indictees, the investigation has been completed and the trial has begun, nor the fact that some states have offered guarantees that they will meet the Special Court's requirements for detainees to hold house arrest in those states (one state is a member of NATO and financial contributor to the work of this Judge)<1>

The late “S, Kosovo Pre-Procedure Judge Nicholas Giju, after the Appeals Court's decision that accepted the complaint of pre-prisoned defenders ordered the Kosovo Police (with an English-language written ordinance, non-official language in Kosovo) that within a set time term, he will respond if he is able to meet the requirements of this trial for house arrest management if this measure is pronounced by any of Kosovo's pre-prisoned, Kosovo citizens. After that request, Kosovo police were subjected to institutional and non-institute pressure for the deadline and contents that should be returned to the Special Court, but that did not affect the professional response it returned to the previous era by providing enough guarantees that it has professional and logistical capacities to manage 100% home arrest in line with Special Court requirements. KMDLNJ has said that the head of this court, Ekaterina Trandafilova, had stated that holding into custody more than a year is a serious violation of human rights, while “tan is not being declared when telling all of Kosovo's detainees and citizens are being held in custody more than a year”.

“Ekaterina Trandafilova had removed from the decision-making college a judge who had indicated the possibility of replacing the house arrest measure if he guarantees a third state, though KMDLNj thinks this measure should be implemented on Kosovo's territory for the fact that the detainees have been arrested and tried according to Kosovo laws. To the detainees in The Hague, the Special Court is flagrantly violating human rights and the European Convention on Human Rights for the fact that they are being held in custody beyond the reasonable deadline. Thus, basic human rights are being violated for a fair, fair, impartial, and politically undictated”.

By not judging guilt or innocence, KMDLNj calls for the Special Court to respect even the minimum standards of respect for human rights for those deprived of freedom who are violating most decisions. If the lawyer's request for the replacement of the detention measure is not considered, guarantee third states, the guarantee of the Kosovo Police (according to the Special Court) would be acceptable to the Special Court for the house arrest to be applied to the Decani Monastery, which is enjoying so much the support of the most powerful states of the international community, as well as the Constitutional Court of Kosovo, as of Serbia”.
