Witness in judgment against Sali Mustafa: I later realized that the accused is responsible for BIA.

Witness in judgment against Sali Mustafa: I later realized that the accused is responsible for BIA.

The sixth witness to the Special Prosecutor's Office(ZPS) in the trial of Salih Mustaf has said that during the war period he was unaware who is in charge of BIA unit, but he later learned that he is Salih Mustafa. During his testimony, the protected witness has [...]

The chairman of the court, Mapie Veldt-Foglia, in an effort to clarify the witness's statements has asked him several times about the person he said he met in his backyard, who he believed held the nickname “Cali”.

According to the witness, after being released from the facility where he claims to have been held in Zlace, in his backyard they were members of the BIA unit and a person who was presented as “Cali”.

The SPS witness has said that others have heard that he is named Salih and that he said he was the leader of that group that was in his backyard.

Judge Foglia: This morning you said that the person who came to your yard was Cal who was responsible for Zlatshi, that's on page 95, line 3 to 7, right?

Witness: I said he was introduced to Cal in charge of that group that were in my backyard, if that's the same person.

Judge Foglia: The person who was present in your backyard named Cal who was responsible for this BIA group will now ask the question, was he BIA's responsible?

Witness: I don't know, he said, "I'm in charge of this group," and I don't even know who BIA was when he showed up at the time, I don't even know about that group, I just introduced what I remembered. I didn't even ask what group it was or what work it did that didn't interest me.

Judge Foglia: The person who came to your house with that group of BIA people he told you himself is Cali and that person over Cal said that the person responsible for BIA is another Cale, that's what you're saying, and you answer to the prosecutor that this is correct.

Witness: But I've recently realized that he's responsible for this group, I've recently realized, not at that time.

Judge Foglia: There's something I don't understand that maybe there's coincidence, so what you're saying, the person that came into your backyard was Cal and that group of people was from BIA, is that correct? And the same person said there was another person named Cal who is BIA's responsibility?

Witness: We've discussed it with the prosecutor here since later I've learned that this person who's accused here is BIA's responsible, because I didn't know who's BIA's responsible. That person who was with me said I was responsible for this BIA group, for this group that was with him.

The hearing of the sixth witness holding the W04669 code has ended with the court's questions.

He claims he was held in a stable in Zlata where he allegedly was beaten by some KLA members.

At the end of the session at the Specialised Chambers in The Hague, he has said that he has not told his family about these events.

I haven't told my family about this issue either, but the time has come after 22 years, which is disturbing for Kosovo, rather than solving issues in its own country, at a very fast time, they haven't been able and yet are not, and it's disturbing for me, for the future of my family and for the future of the right people working for the country. And I'll be co-operative with you every time in the future for everything I remember and you need... I hope that as soon as it's done, all the bright cases, all the people will get the deserved sentence depending on what work they've done, the SPS witness said.

The trial against former Kosovo Liberation Army member Salih Mustafa will continue on Wednesday, November 17th.

Six witnesses have been heard in the trial against Mustafa so far, all protected, whose identity has not been disclosed to the public.

The trial has begun on 15 September 2021 and is the first in Kosovo's Specialised Chambers in The Hague, and Salih Mustafa is the first arrested by the Special.

The Act against Mustafa has been confirmed on June 12, 2020, as he was arrested on September 24th last year, on a war crimes claim.

He is standing at The Hague's detention centre, while in his statement to the court, Salih Mustafa has been declared innocent. /kp/
