Law and security institutions have shown themselves unable to protect the minor from Fushe Kosova, who died two years ago.
The ombudsman has stressed that the tragic case of the 11-year-old, Kujtim Veseli, constitutes violations by institutions that were taken in this case, so domestic investigation by the Kosovo Prosecutorial Council has been sought.
At the summit for antigipsism, the defence has demanded justice for the minor Ashkali community, where it said the case has been neglected because of ethnic affiliation.
In the summer of 2019, memory Wessel was found dead down the stairs of a residential object in the neighborhood of “Xhemajl Mustafa”, in Fushe Kosovo. He had been raped for months by the guy with the S.O. initials.
In the panel of discussion “Inter-sectual Co-operation, access to justice and anti-gipsism broken through the case of Sejm Veselin”, Ombudsman Naim Qeyaj said that in the case of this minor, violations have been made by justice institutions.
There are two concessions that have led to this case, which are unreasonable and at any level of professionalism in the exercise of a prosecutor's work. The suspect who committed the crime has been charged with 18 criminal acts, and has had 29 criminal charges. This is the third circumstance that makes this case specific and specific and tragic. Even after so many years we feel in a difficult position when we speak, because institutions that had to react have shown themselves unable to offer protection to a minor child who is now victim to”, he said.
S.O. has been accused of sexual abuse, even though evidence reports indicate sexual assault. The sentence envisioned with the Penal Code is high, but is followed by regular procedures.
The people's alternative at the time has reacted with recommendation, initially consisting that human rights were violated in this case. The state has failed to act, carry out a positive obligation to protect life, react long ago, and have failed to respect legal duties in criminal procedure to enable the consequence, which has been caused. One of the recommendations is that the Kosovo Prosecutorial Council should begin internal investigation due to prosecutorial concessions in fulfilling the duties and obligations that arise in this case”, Celaj has said.
For one prosecutor, a disciplinary measure of 30 percent of six months has been pronounced.
But for these sanctions, family and defence have had no access to documents.
Lawyer Rina Kika said the case of the late man shows the state's negligence. His ethnic integrity, according to her, has been a factor in not being taken into account by institutions.
“is continuing neglect and ignoring approach to minimize damage. We're talking about a 10-year-old child who's been repeatedly raped. This is also ascertained by the Constitutional Court in Pristina, which has condemned the S.O. 25 years in prison. And this sentence has also been confirmed by the Court of Appeals and the Supreme Court. Why the memory case has been overlooked, for me it is clear that his ethnic affiliation and the objector's affiliation has been an important factor in why this case has not been addressed”, Kika has declared.
On the second day of the summit for Antigipsism, with the slogan “Road for Change”, the justice minister's political adviser Eros Gashi said members of the three communities are facing discrimination in all forms.
We have different forms of manifesting these discrimination. We witnessed the last two events, which constitute typical forms of discrimination. One in Gjakova, where young people from the Egyptian community were not allowed to enter and serve at a bar in gastronomy. And the other in Prizren, where violence was exerted against members of the Roma community, because the same did not possess mask”, Gashi said.
Cameron Wessel's case had appeared in police in January 2019, where the victim's mother had shown that her son was being mistreated. Despite the serious criminal work suspected of, S.O., an interview by Kosovo Police, was conducted only 65 days later. Later, Pristina Constitutional Prosecutorship had said there is no need for the legal examination of Cameron Wessel. He was free until July, when it was reported that the same one violated him and then claimed his 11-year-old life.
