This was after Emmerson had mentioned to the judges the fact that the SPS had been incorrect in its predictions of the start date for the trial against KLA leaders, thus delaying greatly, while KLA leaders are continuing to remain in custody.
Keeping in mind that the next conference date is soon, on October 29th, the defence respectfully requires that the Pre-emptive Procedure Judge issue an order to the SPS as soon as possible to hand over the preliminary file by October 31st”, Emmerson's request said.
Emmerson as an argument has mentioned the magistrate's willingness to give orders for the preliminary file he has expressed at the Conference of Past Statutore.

It is noteworthy that the Preemptive Judge has ordered the Kosovo Police to submit detailed answers on whether he can offer guarantees for the release of the former KLA leaders.
This court ruling comes after police director Samedin Mehmeti had earlier failed to provide sufficient guarantees for the release of KLA leaders. However, the Appeals panel had found that the Pre-Precious Judge had to seek additional details from Kosovo police.
