Nasim Haradinaj's Hysni Gucatt continues detention

The trial chamber, headed by Judge Charles L Smith II, has continued the detention of Hysni Gucatt of Nasim Haradinaj until the decision was made after the information they have requested by Kosovo Police (PK). Specialised rooms have asked Kosovo Police to provide information on this [...] by November 26th.

These information, required by police regarding authority and ability (in particular, in terms of available personnel and resources) to limit the movements of individuals subject to temporary release, monitor and limit the communications of such individuals, manage domestic arrest and ensure the equivalent of the above - mentioned hospital measures.

And the previous instance of implementing such measures involving the provisional release measures mentioned above; and (ii) previous instances of implementation of such measures involving the provisional release of persons charged with acts against justice administration, in particular for works by articles 387, 3888, 392 and 401 of the Kosovo Penal Code”, says in this court order.

Otherwise, at Wednesday's session, in the trial against Gucat and Haradinaj in The Hague, the second witness, Halil Berisha, has continued the testimony. Otherwise, the Haradinaj Gucatt trial began on 7 October this year.

Hysni Gucati, along with Nasim Haradinaj, is being charged with criminal acts against justice administration, specifically with obstructing official persons in carrying out official duties, fearing witnesses, taking revenge and violating the secret of the procedure, reports the “Justice Voughty”.

The “The charges presented in the confirmed indictment rely on well-based suspicion that at least between 7 September and 25, 2020, Mr. Gucati and Mr. Haradinaj uncovered without authorisation protected information from the Specialised Chambers Law, among which identifying data of several (possibly) witnesses, in three press conferences and other broadcast activities, as well as further distribution involving statements on social networks”, it was said in the announcement of the Specialised Chambers.

Gucati and Haradinaj are charged with making derogatory comments against potential witnesses and repeatedly expressed their intention to undermine the work of the Specialised Chambers.

With these actions, Mr. Gucati and Mr. Haradinaj violated the secret of the procedure and feared witnesses (possibly) of the Specialised Prosecutor's Office and subsequently prevented the work and investigations of SPS.”, the Kosovo Specialised Chambers announced.
