Halil Berisha, who has declared from the beginning of his presentation at The Hague that he has been forced to go to testify in this trial and does not feel happy about it, has said he and his fellow editors at the Infocus Journal have made a decision not to distribute the documents he received from OVL-KLA leaders.

Not only in this case but always when a media has material that doesn't have other media then there is co-operation, sharing with others, but usually the highest person in the media hierarchy is asked, no journalists or editors make decisions in this case. We too have discussed with the editorial team of Infocus Gazette and we have come to the conclusion not to share these documents with anyone so that I can't remember there was any request to get the media papers, but these requests have gone to the people who were in the hierarchy higher than I was, Berisha said.

Halil Berisha, former journalist and editor at the Infocus Journal, is the second witness in the trial of Hysni Gucatt and Nasim Hardinaj.

He had reported on the first OVL conference- The KLA about files that Haradinaj's Gucati is accused of, where he had received a copy of them.

The hearing of Halil Berisha has ended today in the Specialised Chambers in The Hague, while the trial is expected to continue tomorrow with the presentation of the third witness in this case.

And Hysni Gucati's lawyer, Jonathan Elystan Rees, has said the actions of OVL-KLA's former head have been in public interest.

Mr. Gucci has done what he did for the public's interest, we're going to assume that his behavior and actions do not work criminally. If the court is against us in this position then we'll say he's acted on being promoted by others, and as we've raised this is a case in the sense that who's been promoted, and as far as this case is concerned, there's going to be police incentives and we're going to have to consider that which's involved in this incentive to commit crime”, the lawyer Reess said.

He has said he will assume that Gucati's actions do not lead to criminal acts.

“We will ensure that in the first instance, the court examines what actions Mr. Gucati has taken and whether these actions lead to criminal acts or not, we will ensure that his actions do not lead to criminal acts and part of these statements will include mentioning public interest. If the court is against us and if we are to make decisions for the contrary then we will ask the court why he has acted, not as far as the public's interest track is concerned, but what happened before that and we will follow the path of incentive to do the”, Rees added.

While Nasim Haradinaj's defence, Toby Cadman has said their position is the same as that of Rees attorney.

Former heads of the KLA War Veterans' Organisation, Haradinaj's Gucati, are charged with criminal acts against justice administration, namely obstructing official persons in carrying out official duties, fearing witnesses, revenge and violating the secret of the procedure.

In the organization they were running, there were several packages allegedly containing documents derived from the Special Prosecutor's Office. All of this they had made public through media conferences and other public presentations.
