Ends hearings, SPS witness continues to be heard tomorrow in Specialised Chambers in The Hague

The hearings in the Specialised Chambers in The Hague, where the trial is under way against former heads of the KLA War Veterans Organisation, have followed and closed in parts where the defence attorney has presented several articles published in Kosovo media, in which some of them are mentioned by people, some of them Serbs. During the hearing, the defence attorney has asked the investigator about the resignation of the former specialised deputy prosecutor and whether the OVL offices should be kept under surveillance- The KLA after 7 September, in order to prevent the flow of other documents.

By order of the court, the parts where names related to possible witnesses or witnesses should not be public.

ZPS Witness Zenka Pumper has responded to the defence of Hysni Gucati, lawyer Jonathan Elusan Rees, where many of the questions have been rejected by the procuratory Valeria Bolic.

Lawyer Rees: Paragraph 16 of your statement number 084015, in paragraph 16 you say you saw an article called “The other specialised Chambers scandal, it has co-operated with Serbian Army officers who have been active in Milosevic's time”, published in the New Born newspaper. When did you see this article?

Prosecutor Bolic: We object, for reference to the title of the article, regarding the order the presiding judge gave.

Judge Smith: Your opposition is not acceptable.

Lawyer Rees: When did you see this article, please?

Witness Pumper: In due time, when I was preparing for this statement.

Prosecutor Bolic: I object.

Lawyer Rees: I want the witness to confirm if it can be that this website continues to be available today, issues that we think are fully related to what you said as a jury whether this site was or whether it was still confidential, this is related.

Witness Pumper: I don't remember the way I went for the address you read to me.

Lawyer Rees: This article that you have considered, which we read to the title, the first paragraph says the other <x0documens talk about the collaboration that Special Chambers have had with employees, Serbian officers who have been active during Slobodan Milosevic's time.

The hearing has been followed and closed by the court's decision so the complete article can be read.

While according to attorney Rees, the defence is getting harder to question since they cannot use nicknames on certain occasions.

He has asked the witness about the resignation of former specialised deputy prosecutor Kwai Hong.

Lawyer Rees: The names of two Serb officers mentioned there, who have been present in some of the massacres committed by the Milosevic regime, the New newspaper. Born received documents showing Serbian officers have been contacted by Special Chambers to give evidence against KLA and its members. The final paragraph of the article states that the specialised deputy prosecutor has assigned thousands of files, which reportedly contain other names of other witnesses. Can you help us if it's true that Kwai Hong quit after this information came out?

That question has been disputed by prosecutor Bolic, yet attorney Rees has insisted on his question.

Lawyer Rees: Can you confirm Kwait Hong quit after this news came out in September, 2020?

Witness Pumper: I don't know why he gave up the SPS.

Lawyer Rees: Can you confirm he left in September 2020?

Witness Pumper: Yeah, as far as I know. If you let me go back, after September 2020 I can't confirm, I know he's resigned.

Among other things, the lawyer has presented a document that is supposed to be a requirement for co-ordination addressed to a Serbian official and holding the signature of the specialised former deputy prosecutor Hong.

During this session, witness Zenka Pumper has indicated that she was not present during the selection of documents from O VL-KLA.

Lawyer Rees: When the press conference took place September 7, 2020, and in the coming days it was made public or not that at least there was the potential that other documents of a similar nature were submitted O VL-KLA.

Witness Pumper: I read on press conference transcripts.

Lawyer Rees: If the documents you labelled as package 1 contained as you claim really confidential and delicate material, the ZPS would be able to imagine, would it be willing to prevent the extraction of a similar nature, please?

Witness Pumper: I have no involvement in any activity before the 25th of September and I have limited knowledge of it.

Witness: I'm not wanted.

Lawyer Rees: You're the coordinator of the investigation experience, right?

Witness: I have 20 years of experience in investigation.

During the hearing, attorney Rees has asked the witness, as she is a 20-year-old job investigator, whether they should be kept under surveillance by the offices of the KLA War Veterans' Organization after the first day of the paperwork, in order to prevent the flow of other documents.

Lawyer Rees: If you had been assigned September 7th to coordinate the investigation because as you now admitted it was no secret that there was a possibility that other documents were sent to OVL offices- KLA, wouldn't you think that offices and environments around offices would be kept under surveillance on your part so that you could stop handing over such documents?

Prosecutor Bolic: Objection, this question comes out of the question that the defense side has asked the witness.

Witness Pumper: If I was assigned duties to coordinate this, I could have considered any option, possibly even keeping an eye on it.

Lawyer Rees: So you would consider it if it was loaded on you. But are you aware that someone else did it?

Witness Pumper: As I said before, I'm not aware, I wasn't involved and I have limited knowledge.

Lawyer Rees: Are you aware that someone has made the decision deliberately not to continue in the central office?

Witness Pumper: I don't know about that.

Lawyer Rees: Who would know about this?

Witness Pumper: The persons who would know about this is only the specialised prosecutor and the specialised deputy prosecutor.

Zenka Pumper has said that the decision to keep an eye on OVL office- The KLA has been of the specialised prosecutor and his deputy.

Your Honourary “, you asked yesterday to find out the answers to the two questions you had and yesterday told me that general co-ordination and management of this investigation was conducted by the specialised prosecutor and the specialised deputy prosecutor, and by this information I guess the decision to decide the offices under surveillance would have been made by them. But it's not like I was specifically told”, the Pumper witness said.

This is the third day of testimony to Zenka Pumper, the ZPS investigative co-ordinator.

Former OVL-KLA leaders are accused of criminal acts against administration of justice, namely obstructing official persons in performing official duties, fearing witnesses, revenge, and violating the secret of the procedure.

In the organization they were running, there were several packages allegedly containing documents derived from the Special Prosecutor's Office. All of this they had made public through media conferences and other public presentations.

They have been arrested on 25 September 2020 in Pristina since they were even held at The Hague detention centre. / KP
