Haxhi Hoti says he did not know it was a criminal offense when he wrote that Prime Minister Kurti could be killed

He has given this statement at the hearing held Thursday at the Constitutional Court in Pristina, during the provision of defence.

I didn't consider this to be a criminal offense, and I made it a comparison to American President John Kennedy, for me it's more like documentary and no criminal work”, accused Hoti said, answering his defender's questions, lawyer Rasim Hoti.

In the prosecutor's question, Yavorka Prlincevic, why Albin Kurti had compared him to Kennedy, the accused has said he had no intention but only compared it.

Besides comparing anything else”, the defendant has responded, adding that he had spontaneously done the post.

I've done other scriptures, this has been spontaneous, and people's reaction has been spontaneous”, Hoti has declared.

He said he had not known there would be such a big reaction to this post.

I said before that I didn't consider it a criminal act, and I don't have a day, and I haven't seen that much of a response from the people”, said the same.

On the other hand, Hoti said that he had erased the post after pressure from the people and after seeing that he had made a mistake.

I've seen it as people's pressure on me and I've seen it's wrong, you've got a huge reaction, so I found it reasonable to delete the post. In democracy are institutions like courts which give the verdict, not the people”, the accused has said, adding that he had not expected such pressure from the people.

He has said that people's pressure has been enormous and that there have been threats against him, so according to him, after 1015 minutes he had even erased the post.

Asked whether he had known what fate John Kennedy had gotten and how his mission had ended as president of the United States of America (SHBA), the accused has said that there is not so much knowledge.

Hoti again declared that the comparison was spontaneous and that doesn't mean he knows something about Kennedy.

After completing the defense on the part of the accused Hoti, the parties have also given the final word.

Prosecutor Prlincevic in the final address has said that following the hearing of the injured Albin Kurti, following the administration of evidence and protection of the accused Hoti, he has confirmed that the latter deliberately and knowingly published the post.

“If we carefully compare two posts in “Facebook” The accused Hoti, we note that he consciously and aware of his action, wanted to commit a criminal act because in his first post he says “Albin Kurti has two options either to release Kosovo or be killed. The word “killed” is the word he wanted to connect Kennedy to the injured Albin Kurti claiming Kennedy was in the interest of the American people to be mayor, in the meantime it was not the interest of the state of America to become chairman and Albin Kurti is probably the interest of Kosovo's population but it is not the interest of the state of Kosovo to be prime minister. That post was made wanting to hurt Albin Kurti in the position she was in, the prosecutor said.

According to her, the accused Hoti has been aware of what his actions can produce, so the same has proposed that the same be found guilty, for according to her a major political representative who has democraticly received the support of the people.

While, his defender, lawyer Rasim Hoti, has demanded that his defender be acquitted of the prosecution, as he said the accused had not known that they would have reactions or concerns in the people, or major concerns in opinion and mass, reports the “Justice Voughty”.

I have a huge dilemma that in the penal code a criminal offense, the major concern that has been done to the users of the social network or opinion, and at the whole measure, as the prosecution claims. As a defense I've been interested in this sentence and questions on the part of the prosecution, which I have as a defense since the preliminary-investigative procedure, I've clearly clarified what criminal acts lead to the conduct of criminal acts 172, concerning 32 Par3 of KPRC”, the lawyer said.

He has said that the injured Kurti himself has declared that he has not felt at all endangered and that this post has not posed any risks and that it will not co-stick to prosecution, nor will it apply wealth-juridic demands.

The prosecutor has offered no evidence to convince the court that my defense post represents criminal acts and had no further evidence to convince the court that my defense committed criminal work, then I propose that, in the sense of Article 364, the RPPK's to bring down a legal act of”, the lawyer has said.

Court Speaker Allten Murseli has announced that the court's announcement will take place on October 11, 2021, at 09: 00 p.m.

Otherwise, Prime Minister Albin Kurti had given up his densmine on September 15th.

The Constitutional Prosecutor in Pristina on January 23rd 2020 has filed charges against Haxhi Hoti, with the argument that he committed criminal work “in the conduct of the murder affair”, by Article 172 concerning Article 32, KPRC's paragraph 3.

According to the indictment, on December 28, 2019 the accused Hoti on the social network “Facebook” has made public appeal and push in the assassination of party chairman “Vetevendosje”, Albin Kurti, in his post “Albin Kurti has two roads or let Kosovo go or he can be killed”.

As stated in the accusation, the accused Hoti has compared the injured to the late John F. Kennedy, “John F. Kennedy was the interest of the American people to be president, but it was not the American state's interest to be president” as well as “Albin Kurti is the interest of the people of Kosovo, perhaps, but it is not the interest of the state of Kosovo to be Prime Minister”.

The prosecution claims that the accused Hoti has caused serious concern to the users of the social network “Facebook” in Kosovo and around the world.
