RGK through a communiqué stresses that since by law this criminal act is condemned 5 to 20 years in prison, Peja's Constitutional Court has failed to pronounce the penalty for violence against girls, reflecting once again the lack of institutional response to gender-based violence cases.
“In this decision, the court has used unacceptable and scandalous reasoning, such as the argument that “victim had suffered no injuries”, and that the accused “had correct behavior”. Such reasons only confirm that the victim has not been a priority for the Constitutional Court in Pec. RGK estimates that such low decisions are only motivating more rapists, while they are undermining women and girls to report the violence against them. So by means of this statement, RGK is looking for the Founding Prosecutor's Office in Pec to explain whether they have complained against it at the Court of Appeals. Remembering that the Constitutional Prosecutor is responsible for treating these cases by defending the victims and conveying cases to the end, not only by sending the indictment”, it is said in response.
RGK reiterates calling on institutions responsible for justice such as Court, Prosecutor, and Kosovo Police to address cases of violence against women and girls prioritized, always having the victim based approach at the centre.
