The Constitutional Court in Pec, the Department of Criminals, has announced that it approved the Constitutional Prosecutor's request in Pec for the appointment of the detention measure against defendants I. M, E.Z., M.I. and J.A. and the appointment of house arrest measures against defendant M. J, because of the suspicion based that [...]
On the 1210,2021 and continuing until the date 16,10,2021, acting as an organized group, participate in trafficking in human beings and one of the injured, which, under threat and use of force, puts it into use for material gain through paid sex services with other people.
These acts of defendants had to commit criminal work Trafficking in People Article 165 par.3 connected to par.1 and Article 77 of KPRK.
Defendants I. M, E.Z., M.I. and J.A. were assigned detention measures in length of (1) months, while defendant M. JJ has been assigned house arrest measures in length of (1) months, since the court estimated there is doubt that they have committed the same criminal work for which they are suspected. Given the serious nature of the criminal act for which very high sanctions are presented, the court has estimated that there is doubt that with the finding of defendants in freedom, it could deliberately avoid contact with competent state organs, while, given the way and circumstances of performing this work, there is danger that defendants will repeat the same work or commit new criminal acts at the expense of injury or other persons. Also, witnesses have not yet been heard in this case, medical examinations have not been conducted, and other evidence that is important for the investigation, so with the possible finding of the defendants in freedom, there is the danger of the same affecting witnesses and preventing the course without obstacles to the procedure.
The court under official office praised other alternative measures for the security of the defendant's presence in the procedure, but found that no alternative measure would be adequate at the stage of the procedure.
Against this decision the dissatisfied side has the right to complaint at the Court of Appeals.
