From this analysis, based on the documents released, the procurement has analysed the contract report and the tender file, where it found that the accounting Authority for this procurement activity has presupposed the process of spending the amount of 2,900 euros.

Also, the AKK has asked the Economic Operator to provide at least one contract and a reference to similar or similar supplies (food supplies) worth 4.350 euros in the last three years, which is due to the release date.

According to the Anti-Corruption Agency, this is considered to be incompatible with provisions of the law in force for public procurement, more precisely with Article 69.
The agency considers that the contracting Authority has no right to limit the number of contracts and references to the specified value.

The important thing for the Accounting Authority is to prove that economic operators meet the minimum value, which has been requested on the part of the Accounting Authority, despite the number of contracts and references.

Also, the AKK has considered that such violations should not be allowed in procurement activities, so it has recommended that these violations be avoided, through standard reporting for additional information and for improving mistakes, by reporting to operators who have withdrawn the tender file. /mitrovica reports/
