The Supreme Court decides ) partially two complaints of political subjects are accepted, three other Pristina are rejected, January 29th 2021 the Supreme Court has accepted five complaints from political subjects exercised against the decisions of the Access and Parashta (PZAP) panel, which are divided by lots and examined by judicial colleges within legal terms.
- The complaint exercised by the political subject Vetevendosje Movement has been partially accepted by the Supreme Court's college. Partly changed decision of PZAP, Anr.17/2021, and Central Election Commission decision (KQZ) No.244-2021, regarding the certificate of candidates for MPs, ordering the CEC, which candidates for MPs Libun Aliu and Labinoette Demi Murtezi include on the candidate list for MPs. Meanwhile, LVV's complaint has been partially rejected, confirming PZAP's decision.
The Supreme Court of Kosovo has partially accepted LVV's complaint about Libun Ali and Labinos Demi Murtez, as it has been found that PZAP has made the wrong assessment of the 3 year term by counting the day of the January 6th 2021 election declaration as a final day to assess the three-year deadline for the candidates' eligibility, in the sense of the prescribed provision. The Supreme Court of Kosovo has estimated that the 3-year term should be calculated, referring to the date of the firm form criminal bias for each candidate separately until the date of elections -- in this case, February 14, 2021.
- The complaint exercised by the political subject Alliance for the Future of Kosovo (AAK) has been partially accepted, founded by the Supreme Court's college. Partly changed decision of PZAP, Anr.15/2021, and Central Election Commission decision (KQZ), No.240-2021, regarding the certificate of candidates for MPs, ordering the CEC to have the candidate for MP Semsedin Dresaj included on the candidate list for MPs.
Meanwhile, the AAK's complaint has been partially rejected, confirming the rest of the PZAP decision.
Even in the case of partial acceptance of the AAK complaint, it is about the wrong assessment of the 3-year term, while it must refer to the date of a formal form criminal bias for each candidate separately, until the date of election holding, in this case, February 14, 2021.
- The complaint exercised by the political subject Ashkalije Party for Integration (PAI) has been rejected as unfounded by the Supreme Court's college.
