Vjosa Osmani has long disagreed with Valdete Daka. Yesterday, she warned measures against the institution that organises the elections, while it was reported how the president's task leader could also think of dismissing the CEC chairman from office. Osman Sí has liked not only the failure of the LVV candidate list for MPs who have been sentenced in the last three years, including Albin Kurtin. U.d. The president's statement was exasperated by Dama's before announcing the date of the extraordinary elections.
On behalf of the protection of the CEC's integrity, Vjosa Osmani can dismiss the head of this body, Valdete Daka. With an unusual address, Osmani warned on Saturday to take measures, while it was reported that the law on general elections gives her the right to dismiss the CEC chairman from office.
If we face such situations in which the CEC is abused to push forward the party agenda on the part of CEC members, I will be forced to take all measures for the integrity of the CEC and the electoral process”, Osmani said.
The long meeting of the CEC on Friday, where it was decided not to certificate the list of the LVV, which included itself, Osman called it offensive, saying the director of the Office for Certificate of Political Subjects was pressured.
What we saw yesterday in the CEC has been unprecedented, indecent and unacceptable for an institution that has to do its best to protect integrity. In live transmissions, tremendous pressure was put on the director of the Office for Certificate of Political Subject”, Osmani said.
She estimated that CEC chairman Valdete Daka must fulfill her legal obligation as she has sworn in, which Daka said she was doing during Friday's meeting in the CEC, where she requested additional documents from the Office for the Certificate of Political Subjects, citing the risk of breaking the law and the Constitution.
Presidential duty lawyer Vjosa Osmani, before setting the date for holding the elections, wanted no complaints from the Central Election Commission regarding the preparation of the elections, which she was due to announce as soon as the full act of justice arrived at the office.
Osmani on 22 December and 23 December had shared political party representatives to discuss the most favourable date for holding elections. For election day, she had not discussed the CEC, while the chairman of the body responsible for organising the elections, Valdete Daka, had told Express that Osman would have to consult them.
Daka hoped Osman would take into account the CEC's request and use the constitutional deadline for setting the date for holding elections.
“But now, of course, the CEC also needs to be consulted on possible deadlines and dates for holding elections. We know she's on the discretion of the President's duty to announce elections. She would certainly take into account all the demands, both of the political parties and the CEC's bid”, Daka had said.
Statement of the extraordinary elections, President Vjosa Osmani's post, on January 4th said it would make “the moment the act comes” because, as he said, “the parties' overwhelming majority during consultations we have expressed on the election as soon as we can get to”. On this occasion, Osman also sent the CEC a message to organise elections quickly, just as he had done in the past and had asked Valdete Daka not to complain. She had added that instead of expressing concerns, the CEC had to work.
The various processes that exist within the CEC, which usually may have long-term complaints, are such, but I don't think we should hear complaints. It's not the first time the CEC organises elections in 40 days, it's happened before. Just as they made preparations in the past and have made public talk with full confidence that all preparations will be made and citizens will have the opportunity to vote and realise their constitutional right, I expect and demand that the CEC... I don't believe that we should listen to the CEC right now expressing concerns, but we should see the CEC working and making necessary preparations so that our citizens, but also those who live in the gates as soon as possible, offer the possibility of voting”, Osman had said at “Kalxho.com”.
On the other hand, Daka had indicated that “on whatever date they set, we would organise elections”, but had added that it would be better left more time, demanding an opportunity for the organisation to get better.
And the more time we have, the more we are able to make better choices and give all citizens space to vote. We have a constitutional obligation to organise elections, but the longer we are left, the better. We're just looking to be given an opportunity to make the best choices and have the comfort of the time”, Daka said.
Osmani in advance, had indicated that “in the time of extraordinary elections has no working hours, 24 hours' work”. Daka said they would work overtime.
On Friday, the CEC decided not to prioritise the candidate lists of the Vetvendosje Movement MPs, the Alliance for the Future of Kosovo and the Initiative, as these political subjects had not replaced the candidates who had been sentenced in the last three years with a conviction of the formal form by the tribunal. Special attention was received from LVV candidates, including the chairman of this political subject, Albin Kurtin, while a complaint was submitted to the Electoral Panel for Anxiety and Parashtre (PZAP).
The Office for Certificate of Political Subjects recommended on Friday that all candidates of all political subjects be certified in packages, but such a decision was considered to conflict with the Constitutional Court's act, which ordered the collapse of the Government and the proclamation of new elections.
The important part of the Constitutional Court became a conclusion in it, which in most cases was interpreted to prohibit the election candidacy of all those who in the last three years have been sentenced to court-cut bias. Thus most members of the CEC, who voted not to certificate lists that have candidates convicted in this way, performed.
Unrecognized, the second ruling in the Constitutional Court Act says: “on the basis of Article 71.1 of the Constitution of the Republic of Kosovo, in liaison with Article 29.1 (q) of the Law for General Elections, the person convicted of criminal acts with a decision of form cut in the last three (3), cannot be a candidate for MPs, nor gain a valid mandate in the Parliament of the Republic of Kosovo”.
Political parties whose candidate lists have not been certified are able to appeal the CEC's decision, as did PZAP's until 31 January, when the period of complaints closes, so that on February 2nd the draw of lots can be made possible for the rankings of political subjects in the balloting of these elections.
After the PZAP, parties may also complain at the Supreme Court.
