Tomorrow it is decided for MPs candidates with law problems

Political party lists with parliamentary candidates will be subject to verification in six institutions.

This is what CEC spokesman Valmir Elez said. “have been sent to 6 institutions of separate paperwork to request confirmation of the candidates' adaptability with Article 29 of the General Election Law. These papers have also been attached to the candidate list for MPs who have surrendered to the CEC. Article 29, which speaks of adaptability or candidate capacity, shows who cannot be certified as MP” candidate, Elez said.

From the Kosovo Judiciary Council, T7 have indicated the process of verifying candidates.

We like the KDK already have a database on which all persons sentenced to a firm form bias are registered. Data from this registry can be verified in a very short and fast time. Two days, to make this verification is more than enough for us as an institution. The verification process is quite simple, since it simply confirms whether any candidate of political subjects exists on this database or not.”

If the KDR finds that people who have run for MPs have full sentences, the Central Election Commission should reject the certificate of participation in the February 14th elections.

Even in the Constitutional Court's act, it is said that a person convicted of criminal offence with a court decision of the form cut in the past three years can neither be a candidate for MP nor have a valid mandate in the Kosovo Assembly.

Lists of candidates for political parties' deputies for the 14 February elections have included several persons convicted of bias in the last three years.

The Vetevendosje movement has 10 candidates with active charges, and two candidates sentenced in the past three years. Among them are Albin Kurti of Albulen Haxhiu, who were sentenced on parole in September 2018 because of the drop of tear gas in the Assembly.

The AAKA has eight more active candidates. The PDK has four candidates with active charges and one convicted in the past three years.

The initiative has one with an active indictment and two convicts in the last three years. One of them is Besnik Berisha, former head of the Department of Internal Affairs Manufacturing Division, who was sentenced to 6 months in prison on bail for “the discovery of official secrecy” in March of 2018.

The Serbian list has one with an active indictment and one convict. Milan Aritonovic from the Serbian List is sentenced to 500 euros in fines by the court for false property reporting.

Meanwhile, the Democratic League of Kosovo has only one candidate with an active indictment.

These are all institutions through which MPs' lists for verification will pass:

Germa réé at Article 29 stresses that the candidate cannot be a member of the Kosovo Intelligence Agency. Therefore, to ensure that candidates are not members of the Kosovo Intelligence Agency, we have asked the institution to submit to us the names of people from the candidate list if they are members of the Kosovo Agency for Intelligence.

Germa écé at Article 29 stresses that the candidate cannot be a person who is: c) a member of the Kosovo Police. Therefore, to ensure that candidates are not members of the Kosovo Police we have asked the Ministry of Internal Affairs to send us the names of people from the candidate list if they are members of the Kosovo Police.

Germs '%b and ikk at Article 29 stress that the candidate cannot be a person who is: b) a member of the Kosovo Security Force; and k) a member of the armed forces of any state. Therefore, to ensure that candidates meet this criterion, we have asked the Defence Ministry to send us the names of people from the candidate list if they are members of the Kosovo Armed Forces.

Germa égé at Article 29 points out that the candidate cannot be a person who is: g) diplomatic representative. Therefore, to ensure that candidates are not diplomatic representatives, we have asked the Foreign Ministry to send us the names of people from the candidate list if they are diplomatic representatives.

Germat '%aʹ, épé and éq at Article 29 stress that the candidate cannot be a person who is: a) judge or prosecutor in Kosovo or elsewhere; p) by means of the court's decision has been denied the right to be a candidate; and who is convicted of criminal acts with a final court ruling in the last three (3) years. Therefore, we have asked the Kosovo Judiciary Council to send us the names of people from the candidate list if they are judges; if they are subject to the court ruling with which the right to be a candidate has been denied; and if they have been convicted of criminal acts with a final court ruling in the last three (3) years;

Germat éoé, ér , and ésé at Article 29 stress that the candidate cannot be a person who, by the court ruling, including PZAP's decision has been denied the right to be a candidate; r) has failed to pay the fine imposed by PZAP; and s) has failed to uphold any PZAP orders. Therefore, we have asked the Electoral Panel for Anxiety and Parastance to send us the names of people from the candidate list if they are subject to the PZAP decision to withdraw the right to be a candidate; if they have failed to pay the fine imposed by PZAP; and if they have failed to abide by any PZAP order.

In the spirit of constitutional and legal obligations for interilateral co-operation, we have asked these institutions for the shortest possible term, but not later than January 20, 2021, to answer our calls for verification.
