Guillou has found that there is nothing new to change Procrouse's claims concerning the dangers of escaping Salih Mustafa, witnessing intervention and the possibility of committing any crime.
“The judge of the preliminary procedure finds that there is no information or development in the current procedures that undermine the definition that there are grounds to believe that the three risks envisioned in Article 41 (6) (b) (i) é (ii) of the law continue to exist”, the verdict concludes say.
Mustafa had submitted had offered some conditions for release, but those for the Special Court are insufficient.
Any assurance that Mr. Mustafa could give it up would be insufficient to ensure compliance with any conditions or overcoming concrete release risks. In such circumstances, release, with or without conditions, should not be given”, the decision says.
On September 24, 2020, Salih Mustafa was arrested with an arrest warrant issued by Guillou and is being held in the custody of the Special Court in The Hague charged with war crimes and crimes against humanity.
