Lukic was convicted of murder, persecution, deportation and other inhumane acts as part of crimes against humanity and violations of the customs of war.
He moved to Poland in 2015 to serve his prison sentence.
The International Mechanism for Criminal Court decision (IMCC) says Poland previously briefed the Mechanism that it cannot execute Lukic's sentence beyond a certain day in January 2021.
Under the law in Poland, the maximum penalty for this type of crime is 15 years and since the country in which Lukic will continue to suffer the remaining sentence has not yet been determined, he will expect a decision in the UN detention unit.
