REL: Today, the full Act of Judgment is expected to be published that brought down the Hoti government

According to Radio Free Europe on Wednesday, Kosovo's Constitutional Court is expected to publish the full indictment regarding the Kosovo Government vote, led by Avdullah Hoti. On December 21, 2020, the Constitution had concluded that the government elected on June 3, 2020, was not in compliance with Article 3's paragraph 95 [election]
On December 21st, 2020, the Constitution had concluded that the elected government on June 3, 2020, was not in compliance with Article 3's 95 [government election] article because the government had not received the majority of votes of all MPs.
This was due to MP Etem Arifi's vote, which, on 3 June, voted for the Hoti Government, though it had a strong form penalty for criminal work “subsidies”, for one year and three months in prison.
The parties in this case are the already incumbent Kosovo government and opposition party, Vetevendosje Movement.
Former Constitutional Court Vice President Kadri Kryeziu told Radio Free Europe, that failure to publish full justice by the court so far concerns formal language translation procedures and reasoning of the verdict
Whatever's in public opinion has been only available, the reasoning must now be made. The reasoning is done very professionally and in a volume of over 30 to 40, up to 50 pages. Here's the problem, there's no delay”, Kryeziu said.
But, Judge Mushkolaj, professor at the University of Pristina and former judge at the Constitutional Court of Kosovo, tells Radio Free Europe that the court has passed the possible timelines based on regulations for publishing full justice regarding Government Hoti.
“Afat has expired for this. I'm saying this because we've seen the parts and the reasoning on notice. This means that the [public] deadline is over is ten days' maximum, when the text must be circulated to judges before it is published. I know the working policy says it's possible the judges decide to cut that ten-day deadline. If the publication of the court's announcement has taken place, it means that the deadline no longer existed. The only thing the court has ever been able to do is translate. In addition, if anything should be corrected, that correction should be no more than correction involving any technical correction, plus the court would have to make a very special decision on such correction”, Mushkolaj said.
President Vjosa Osmani's post has already held the first meetings with representatives of political parties for consultations about the date for the new elections, but according to it the decision will be made after the parties take the Constitutional Court's full justice for the Government of Kosovo.
Political analyst Albert Krasniqi from the organisation Democracy Plus told Radio Europe free of charge that the process itself has been delayed by the Constitutional Court, since, according to him, it has been more than six months since the court has proven that a coalition decision has been unconstitutional.
“Of course, the delay in the act also represents this definition further because if there was a faster or earlier publication, the country would go to the elections and certain things would be clarified over time. So, of course, it negatively affects the delay in publishing this act. This delay affects the court's reputation, affects the performance of other institutions”, Krasniqi said.
Whatever the case, political party representatives after meeting with the president's task attorney Vjosa Osmani have mentioned the end of January and the beginning of February 2021, as the possible period for holding elections, following the December 21st Constitutional Court's decision, which said the Kosovo Government, led by Avdullah Hoti, was elected unconstitutionally.
