Miftaraj for complaints at the Supreme Court: Decision expected to be same as Constitutional

The Vetevendosje (LVV) movement and the Alliance for the Future of Kosovo (AAK) after the recent decision of the Anques and Prescriptures Panel (PZAP), which says some of the candidates who have problems with the law from these political parties cannot compete in the February 14th elections, have submitted complaints to the Supreme Court today. [...]

In this regard, Kosovo Institute for Justice Director Ehat Miftaraj has said that if the issue is judged by the judicial perspective, the epilogue knows how to be decided in this case by the Supreme Court.

According to him, even according to the practice of the European Court of Human Rights, the legal tool is accessible but exclusive without allowing for actual change.

The right to complaint is the right guaranteed with the Constitution and the law. However, in a concrete case, if we judge this issue from judicial perspective, we have a situation that guarantees the right to complaint but that previously knows the epilogue how to be decided in this case by the Supreme Court. In this case, even according to the practice of the European Court of Human Rights, the legal instrument is accessible but illusion without enabling to change the actual state of”, he said.

Miftaraj also clarified that the Constitutional Court is the final authority in Kosovo for interpreting the Constitution.

The Constitutional Court is the final authority in Kosovo for interpretation of the Constitution and judgment if a guaranteed right with the Constitution is limited by institutions in the Republic of Kosovo. In this regard, the Constitutional Court has decided on the matter, and it can also be referred to as a judged case by not giving space or access to regular judicial institutions to decide otherwise. This principle is certainly valid if institutions respect the decisions of the JCK, which have a legal obligation of”, Miftaraj has said among other things.

Otherwise, the Election Panel of Pollies and Parasites (PZAP) on Tuesday has partially rejected the complaint of the Vetevendosje Movement and the Alliance for the Future of Kosovo submitted to the PZAP, following the failure to mail the candidate list of MPs from the CEC.

According to the decision published by PZAP, by LVV, Albin Kurti, Albulen Hadziu, Libran Aliu, Bajram Mavriqi and Labinote Demi-Murtezi, and by AAK Shemeddin Dresaj, Gani Dresaj, the Ajeti beat and Albanian Kastracti cannot be certified for early parliamentary elections to be held on February 14th.

By P ZAP, the LVV and AAK list, except for the highly mentioned candidates, can be certified.
