KMDLNj reacts to special decision not to release former KLA leaders on bail

Special Court's preliminary procedure judge Nicholas Giju, under the “principle that I killed you, repeated that the slain “is rejecting all requests of the accused's attorneys, Hysni Gucati, Nasim Haradinaj, Salih Mustafa, Hashim Thaci, Jakup Krasniqi, Rexhep Selim and Kadri Wessel for protection in freedom. There is no argument offered by defence lawyers who are not refused by this judge and who can easily be suspected of participating in sensitive files that have been introduced in front of the KLA offices after which Hysni Gucati and Nasim Haradinja were arrested with the reasoning that by revealing the identity of protected witnesses, they are seriously risking the lives of these witnesses and their families. If they had investigated within the Special Court for the flow of sensitive files and had taken legal action against those who sent these files to the OVL offices of the KLA, then the arrest of KLA leaders would have been reasoned. However, since no investigation had been made and none of the Special Court staff in The Hague has been taken into responsibility, the appointment of Hysni Gucatt and nasim Haradinja, KMDLNj only considers it an excuse for the arrest of institutional and KLA leaders. In one word, the files smuggled by the Special Court, whether sold at a large price, given for political or other purposes, have served as accelerators for political prosecution, as it has produced political effects and direct consequences -- Hysni Gucatit, Nasim Haradinaj, Hashim Thaci, Rexhep Selimi, Jakup Krasniqi and Kadri Wessels.
The discharge of top secret files by the Special Court is the work of an organised criminal group that has so far not been found in the fact that efforts have not been made to reveal. The reason they did this is not known until this criminal group is discovered within the Special Court. Suspects of this criminal activity that extremely endangers the lives of witnesses of this court are all employed in this court, from Chief Prosecutor Jack Smith to the trial judge, Nicholas Giew. That's why the investigation had to be made in order to reveal the responsibility address. Nasim Haradinja and Hysni Gucati are victims of manipulation by the Special Court itself, which has released sensitive files in circulation.

On the other hand, the same prosecutor and the Court, at every request and reasoning of the verdict, names and surnames of those who have given interviews or prononciations that they appreciate can be used as evidence and thus risk their lives directly. The most obvious case is former adviser to Albin Kurti, whose proposals the Prosecutor and Special Court use as key arguments to keep former KLA leaders in prison by risking his life, even at the risk of his family's life. This procurement manipulation and Nicholas Guy professionally is harmful and morally low because, on one side, he tries to protect the identity of protected witnesses and, on the other hand, repeating it, by name and by name, everyone who goes for it, actually makes them targets that are at 24 hours and that are not protected at all. Neither the Prosecutor nor the Special Court have the right to misuse public personalities' statements and proposals as they are now, risking their lives directly because they are being described as those who are holding former KLA leaders in prison and who are far from true.
And, as the last argument of which KMDLNI considers a terrible pretrial and contrary to the principle of presumption of innocence, is the fact that both prosecutor Jack Smith, in demand for continued detention, as well as for preliminary procedure judge Nicholas Giyotina on the grounds for his refusal to be released, until trial, claim he can be sentenced to life imprisonment, even if judgment has not even begun. If the prosecutor could even request this sentence, the Prosecution Judge, Nicholas Giyotina, cannot subject himself to prejudice without the end of judgment. How things are going when the so-called Special Court Constitutional Court and the institution, unfortunately called Ombudsperson, are not reacting at all and are not doing any action to protect human rights, whether those of persons deprived of freedom, the threats of Chief Prosecutor Jack Smith and the judges of the preliminary procedure, Nicholas Giyotina, cannot even be taken as prejudice but seriously should be considered their goal, regardless of the means for realisation of those purposes! and are completely opposed to human rights!
