Haradinaj Gucatt session completes, next scheduled to be held in March

KLA War Veterans Organisation deputy head Nasim Haradinaj has refused to appear in The Hague's courtroom for his own guilty or innocent claim. His lawyer, Toby Cadman, has said Haradinaj's refusal of presentation comes in protest of his approach to The Hague.

The judge of the preliminary procedure in Kosovo's Specialised Chambers in The Hague, Nicolas Guillou, at the start of the conference on the performance of Haradinaj's case, has indicated that the latter has refused to report to the Specialised Chambers for plea.

As a result of compliance with the procedure judge, Nicolas Guillou, the March 5th was proposed to hold the next conference, but for the official decision and the date specified is expected to have a confirmation of the following days.

And according to lawyer Toby Cadman, Haradinaj has made this refusal on the grounds of protest about the way he was treated at The Hague.

“We have put in writing why Mr. Haradinaj has refused to appear, he told me that he does not want to participate on the basis of protest for the way he was treated and that a plea be made in his name and that he has told me to attend this session”, the defence said.

At today's session, the Specialised Prosecutor's Office has demanded that the trial against OVL leaders- The KLA begins in the spring of this year, but defence has required more time.

The prosecution has cited February 19th as the deadline for extracting seized materials, while lawyers have demanded that they receive those materials so that they can carry out their preparations.

The assessment that investigations should have started since September or December last year had no connection at all is quite inappropriate. If we look at these materials that have recently been delivered, most of the material will not be given to us until February 19, how can we begin investigating when these materials have not been disclosed to us. I don't see what arguments the prosecution has here. The prosecution says that it is still continuing with interviews with witnesses, that is the kind of concern about the prosecution's willingness to hand over the argument and its position. We should have some sort of clarification, clear deadlines that when she intends to file her files, we can't start our investigations when we don't know what cases have been filed against us”, attorney Toby Cadman said.

As long as they need to complete the defence preparations, Hysni Gucati's lawyer, Jonathan Rees, said it depends on when they will have all the material from the prosecution.

And according to the Special Prosecutor's Office, much of the material has already been extracted.

Lawyers have declared that it takes them two months to prepare defence.

The next conference on the performance of the case will be held several days after February 19th, following the handover of material by the prosecution.

Hysni Gucati of Nasim Haradinaj, head of the UCK War Veterans Organisation, were arrested on 25 September by EULEX police, where the organisation's offices were previously raided.
