In an interview for Online Economy, CEC spokesman Valmir Elezi has indicated which institutions would be directed to make the candidates verify if they are in line with Article 29 of the Law for General Elections.
“In order to implement the Constitutional Court and General Elections Act, the Central Election Commission will co-operate with several institutions, which have their role during the development of the application/certification period of political subjects and their candidates. In this direction, the CEC will submit a request to the Kosovo Judiciary Council, the Election Panel for Ances and Paraseta, the Ministry of Internal Affairs, the Kosovo Agency for Intelligence, the Foreign Minister and the Defence Minister, for verification of candidates under Article 29 of the Law for General Election”, Elez said.
It has shown even more specifically which institution will be directed to verify candidates of political subjects if they are in line with Article 29 which does not allow the Certificate of persons convicted of criminal acts with a final court ruling in the last three years.
The “among the institutions with which the CEC will co-operate during this phase of the election process is the Kosovo Judiciary Council. So in this institution, we will forward lists of all candidates to request verification if they are in line with Article 29 of the General Election Law, in this case with the letter Q of this law, which is mentioned that a candidate cannot be certified as a person convicted of criminal work by a final court ruling in the last 3 years”, Elez indicated.
According to the CEC, the deadline for application to be certified for participation in the February 14th elections is January 16th, and by 6600 this institution will accept applications, unlike the previous time it was completed at midnight. So, to this point, political subjects should also bring out candidate lists for MPs.
The CEC spokesman has indicated that under the operational plan approved by the CEC, the six institutions mentioned above must respond to the CEC's request by January 20th, EO reports.
“Based on the operational plan adopted by the CEC, we expect answers to the candidates' verification from the institutions I mentioned above, until January 20th, as on the basis of this plan it is envisioned that lists with the candidates' names be sent on January 18,”, he said.
The next step after the CEC accepts these answers will be decision-making in this institution.
After we have accepted the answers to verification from these institutions, the Office will submit to the CEC recommendations for approval or rejection of the certificate of political subjects and candidates. If any political subject or candidate is not certified, he could file a complaint in the Election Plan for Ances and Parashtres. The issue could go up to the Supreme Court if the side might be dissatisfied with the PZAP decision. The CEC will act according to decisions stemming from these 48x1> institutions, Elesi said.
According to him, this period of complaints is meant to be concluded by 31 January, so that the withdrawal of the lot for the ranking of political subjects in the balloting of these elections will be made possible on February 2nd.
