Kosovo's specialised prosecutor has filed charges against former KLA member Salih Mustafa, under the claim the same has committed war crimes. The act against Mustafa has been confirmed since June by the judge of the preliminary procedure, while the defendant has been arrested yesterday.
The Act against Mustafa has to do with criminal acts associated with arbitrary bans, cruel treatment, torture and unlawful murder.
These works, according to The Hague's specialised prosecution indictment, have been consumed during April 1999.
However, the indictment compiled by The Hague's Specialised Prosecutor mentions other names of former KLA members, who, along with Mustafa, allegedly committed these crimes.
It mentions soldiers with nicknames “Comandant tabuti”, “Imini Vela”, “Bim”, “Drawing”, and other KLA soldiers.
“include other members of the NKP including KLA soldiers with nicknames "Tabuti", or Commander Tabuti), HINA V ELAU, REMI, CHArdani, Affliction and soldiers, police and other KLA guards present at the Zlach detention complex. Each of the NKP members, through their actions and inactions, contributed to the realization of the common goal. Otherwise, some or all of these individuals were not members of the NKP, but were used by members of the NKP in committing crimes, for the outworking of the joint goal”, the prosecution said.
The prosecution's indictment in question describes how Salih Mustafa, based on claims, had beaten victims with baseball bats.
All these events, according to the prosecution's claim, had occurred at the detention point in the village of Zlath, located in the Pristina suburb.
In addition to torture, Mustafa is also being accused of unlawful killings in wartime.
“Salih MUSTAFA was present when [ REDAKUED] was initially brought to the 2003 detention complex. Several KLA members targeted [ REDAKHED] and he was beaten and tortured more severely than other detained persons. [ REDECT]. During his ban, his family repeatedly sought to obtain information about his fate, but they received false, incomplete information or received no information. [ REDAKUED] was last seen alive on April 19, 1999, or about that date. [ REDECT]. His family never heard from him again. About the end of April 1999, the BIA unit left Zlatshi. The corpse of [ REDOCTURE] was discovered in [ Thirty-three. As mentioned in the above paragraphs 8, 11 and 16, Salih MUSTAFA had the intention and knowledge needed for the crime of illegal murder”, the indictment said.
