Protests against Peter Ndekaj's low sentence warned

For the second time, the Constitutional Court in Gjakova has received a conviction case for accused Peter Ndekaj. The Court has sentenced him to 24 years and six months in prison for killing Valbona Mark and their 9-year-old daughter, as well as a year in prison for the field without permission. []

Peter Ndrecway had been shot by Kalashnikov, his 34 - year - old wife and 9 - year - old daughter.

Erza Kurti, gender-based violence expert from “The Kosovo Women's Network” told Kosova priss, that the sentence against Ndecaj as NGOs has taken with much concern, so they are also planning to hold protests.

According to her, in view of the burden of this work already carried out by the convict, Peter Ndekaj the court would have to sentence him to life imprisonment.

Seeing that the work Peter Ndreczej committed that is double murder of his wife and his daughter is also considered by the law to be sentenced to life in prison. So given the circumstances of killing us is an injustice to the victims once again for this low sentence... We have not yet contacted Valbonne's family. But we're planning to do a protest...03. The 9 protest will be held according to all likelihood this week that as soon as the Prosecutor makes his complaints, even the Court would have to change that decision because it is an undeserved and extremely low” ruling, Kurti said.

Kurti says that such low sentences against the leadings of such serious acts, especially against women, are a drive for abusers of domestic violence to commit such crimes.

This low sentence is unfortunately just a trigger for domestic violence abusers and these criminals not to stop with these acts, because we know that punishment is too low and that's like a greater incentive for them. Unfortunately, we have tens of hundreds of women who experience domestic violence, many victims who have been killed by marriage mates or other family members, so the penalty would have to be rehabilitation for the task. But with this conviction given to Peter Ndekaj is no rehabilitation and no further improvement to the head of the work”, she said.

On the other hand, Gzim Shala from the Kosovo Institute for Justice says the penal policy continues to be problematic in Kosovo, because the principles of condemnation, punishment goals and exacerbating and exacerbating circumstances are not directly assessed.

Shala for Kosova Pres has said that in cases like this of Peter Rudnej, who poses high risk, accused must be punished with the maximum sentence seen by the Kosovo Criminal Code, which is life imprisonment.

“Even in the category of murder punitive policy continues to be problematic. The Kosovo Institute for Justice had long ago published a report in which it had analysed penal policy implementation of punitive policy guides in cases of murder, respectively and had seen there is a non-uniformity and non-consistent in the pronunciation of sentences. ... punitive policy in Kosovo is problematic because mainly because it is not valued directly for the principles of punishment, punishment goals and extenuating and exacerbating circumstances. In cases like this should necessarily be applied to the most severe punishment set forth in the Penal Code in such cases. It is imperative that we have imprisonments of life in prison, especially when it comes to criminal acts of this danger, and that have such dire consequences... in the case of today's bias declared we have not yet seen the written bias, but by what we have monitored in the concrete case is not about any fundamental change of circumstances following the retrial of this case which would affect even the reduction of the <x1 sentence, he said.

The violation for which the Supreme Court had turned the case of Peter Dillacaj into retrial, Shala says it is essential, and for that one must shoulder responsibility.

“The violation of the Supreme Court in the actual case has been an elementary offense that should not happen on any other occasion. So, it's about not accepting full guilt from the defendant, and partly admitting guilt on the same court in the first degree has taken it as an admission of guilt for the entire charge. . Because of this procedural aspect of the whole process has become retrial. And in the very concrete case, we have a first-degree failure, as in the second degree that hasn't left this case before the case goes to the Supreme Court”, Shala stressed.

Peter Ndecaj in November 2018 had been sentenced to 24 years in prison for the murder of his wife, Valbonne and daughter, but in March 2019, the Court of Appeals had changed the act of first degree, condemning him to life in prison for the murder of his wife and daughter in the village of Brecoc, Gjakova.

Apel had estimated that the Court of the First Century did not rightly assess the critical circumstances. But the acts of the Constitutional Court in Gjakova and Appeals were rejected by the Supreme Court, which had demanded that the process return from the beginning.

The Supreme Court had found that in the act of first degree there were substantial offenses of the criminal procedure, after which the Second Court had passed over these violations
