On Wednesday, at the Constitutional Court in Gjakova, the accused has given his defense in the murder of his wife and daughter, Peter Ndekaj.
The accused Ndecaj said the last time, the critical day of the murder, he had gone to take his wife and that he had a Kalashnikov with him.
I went to get my family. When I opened the door, I saw Valbonne and her mother, and after the door hit me, I fired at once.”, the accused Ndecaj said.
He said that after his door had crashed, when the door was opened the second time, he had seen Shkelza, the brother of the deceased behind the door.
He added that after the shootings, and until he had gone to a water where he had washed his eyes, he remembers nothing.
He said in the Police Station he was told he killed his wife, but he thought he killed Shkelzen, brother of the deceased.
While adding that the child has also been killed in court, reports “Justice Trust”.
The accused Ndecaj, beginning his defense, said the deceased's brother had wanted to take his wife to Germany.
He also indicated that he was in one of the prisons in Serbia and that there were problems later, for which he was treated at the psychiatrist.
Otherwise, at the start of the defendant's defence session, lawyer Ndeca Dodaj has proposed becoming a new psychiatric expertise, since the expertise compiled by the expert group, according to him, is incomplete and has not been strictly compiled as the court has requested.
This proposal by the Dodaj attorney has been rejected by prosecutor Ali Uka and the authorised representative of the damaged party, lawyer Isa Osdautaj.
Afterward, Judge Guzim Pozheg's panel of judges has rejected the Dodaj attorney's proposal, arguing that the same is groundless and that the expert group experts have clarified the issue, and that it is also in harmony with expertise made in 2018 in another family violence case.
The final word in this case is expected to be delivered on September 8, 10:00.
Otherwise, the Constitutional Court in Gjakova, on November 2, 2018, for serious murder and illegal possession, had sentenced Rudeca to 24 years in effective prison.
To that decision, all parties had complained, since the State Prosecutor and the damaged party had sought life imprisonment, the defence had demanded a milder sentence.
However, on March 1, 2019, the Court of Appeals had announced that it had changed the Constitutional Court's decision in Gjakova, and Ndecane had been sentenced to life imprisonment.
The municipality of the Court of Appeals said that the actions of the accused Ndecaj have been renamed as “severe suicide” by Article 179, paragraph 1, sub-paragraph 1.11, the Penal Code of the Republic of Kosovo (KPRK), and imposed on it a life sentence.
According to Apel, the Court of the First Century has not correctly assessed the serious, particularly demanding circumstances, and that these circumstances dominate more than extenuating circumstances.
However, the Supreme Court of Kosovo has later turned the case into retrial, thus undermining the rulings of the Constitutional Court in Gjakova and the Appeals.
The Supreme Court's college had found that the first degree of judgment is involved in substantial violations of criminal procedure provisions, and that the Court of Second Court, in accepting these defects, in the procedure of admitting guilt, has been obliged to review and cancel the case, not to pass over this violation, which is present and conditioning the constitutionality, because it can be a matter of serious murder by Article 179,1P.1.KP, only if two are committed on purpose.
According to the indictment, the accused on August 7, 2018, in Gjakova, at the victim's family home, has deliberately deprived his wife V of life. N, and his daughter K.N.
The accused allegedly went to the house of the armed victim's brothers, where he shot the automatic rifle in the direction of the house, and shot his ex-wife and daughter, the same wounds have changed their lives.
The Gjakova Constitutional Prosecutor has filed charges against Peter Ndociaj because of the criminal act “heavy murder” by 179 paragraph 1 subparagraph 1.1, 1.3 and 1.11 of KPRK, and for criminal work “control or authorised possession of weapons” from Article 374 paragraph 1 of KPRK.
