All that happened yesterday in Haradinaj's trial

During his presentation, Haradinaj reiterated the stance that he does not recognise the Specialised Chambers and Prosecutor's Office, otherwise known as the Special Court.

I don't know this court, I don't know him, and I won't. You have been given an expired mandate since August 2nd,”, Nasim Haradinaj said. He accused the political scene in Kosovo that for its “posts and salaries”, “have broken the Constitution” for this court.

Against Haradinaj, however, there is no charges filed, the Prosecutor at The Hague said he will do so soon.

Haradinaj was arrested on 25 September in a Pristina neighbourhood by the Specialised Prosecutor's Office, under suspicion of obstructing justice.

The suspect's “for the suspect has been issued as an arrest for criminal acts against justice administration, for fear of witnesses, revenge and violation of the secret procedure”, it was said in announcing these chambers respectively.

Specialised chamber officials during the hearing said Haradinaj's arrest was necessary because “circumstances show there is a danger of his escape, that there is motive, means and opportunity to prevent the performance of procedure” and that he would repeat the criminal work he allegedly carried out.

Prosecution Judge Nicolas Guillou asked the Specialised Prosecutor's Office to present the indictment as soon as possible. As he read his rights to Haradinaj, he told him that he has the right to ask that he be released from custody if an indictment does not rise in one year against him. Guillou also added that he will review his detention, at least once in two months.

Prosecutor: Witnesses Feel Threatened

Prosecutor Valeria Bolic said the Specialised Prosecutor's Office is working too fast to hand over an indictment against Haradinaj.

There are some investigative steps our Office is taking to ensure that the indictment is delivered along with all supporting materials and other relevant materials, to create a complete and depleting file”, Bolic said.

Our “Office is in the process of gathering that information from numerous witnesses who have conveyed to our office that they feel threatened and afraid because of the reasons that have been mentioned for arresting Mr. Haradinaj”, she added.

Defense: Haradinaj not charged with war crimes

Haradinaj's lawyer, Bes Martens, meanwhile, announced that the defence has filed a motion to reject the specialised Prosecutor's claims and motion for his client's release.

This is a war crimes test and my client is not accused of war crimes”, Martens said.

Otherwise, on 25 September the head of the KLA's OVL, Hysni Gucati, also suspected of obstructing justice, has been arrested. The first session to him is scheduled to be held on October 1st.

Gucati was arrested at the offices of the organisation after the Specialised Prosecutor's Office carried out a raid action that lasted more than eight hours.

The arrest of Haradinaj and Gucati occurred after this organisation, which they lead, three times held media conferences where they distributed material allegedly to be confidential documents of the Special Court.

According to them, an anonymous person has handed over to the OVL of the KLA <x0 thousand files containing witness names and addresses”.

After each conference, documents have been confiscated by investigators at The Hague.

The contents of these documents are unknown and have not yet been confirmed if they are authentic.

Otherwise, the Specialised Prosecutor's Office, headquartered at The Hague, announced last Thursday that it has arrested Salih Mustaf, one of the founders of the Kosovo Liberation Army in the Lapi area.

It was the first arrest in Kosovo by the Specialised Prosecutor's Office.

Former Kosovo Liberation Army chief Mustafa, during his first presentation before the Specialised Chambers in The Hague on Monday, has chosen not to be declared over charges of war crimes weighing on him.

Specialised Chambers and the Kosovo Specialised Prosecutor's Office, also known as the Special Court, have headquarters at The Hague and deal with the alleged war crimes investigation of members of the former Kosovo Liberation Army.
