He says that after drafting this association must be sent to the Government and then to the Constitutional Court, therefore it can be against Kosovo's laws and Constitution.
Ferati added that this issue has ended and should not be returned to the negotiating table in Brussels until the call for return on the part of Serbian negotiators deemed it an attempt by Serbia to pressure Kosovo.
The key has remained to draft the statute from the working group and send it to the Government, which then inspects it and sends it to the Constitutional Court for interpretation. Returning to the table means nothing, but insisting on being implemented can also be”.
Former LDK minister in Klan Kosova for the task force of this association, which consists of four Serbs, said it has been a tendency to introduce things that are not in accordance with the country's laws and Constitution, as well as those found in the 2013 court.
I don't know what they claimed, but the very fact that it's delayed and not sent to the Government means that they want to make a status outside the rules and outside what would have been acceptable in Government. The Serbian side will pressure to speed up the process, but there is no need to hurry until dialogue continues and until there is final document of the final agreement.
In 2013, agreement has been reached to establish association, knowing that the Constitution of Kosovo and the laws for municipalities allow for yet another association to be formed, except what we already have. Thus, it can prove that the Constitution allows the formation of association and may be like the existing right to co-operation and the relationship between” municipalities.
Ferati said all findings of the Constitutional are satisfactory and prosper the project.
The Constitutional Court has been very helpful in this matter. All those cases have to be processed. Based on the information I'm working on, it's stuck in the working group. The drafting of the statute is their duty that the government has yet submitted to the proposal-state”.
He said the government could reject the Association statute when it is sent by the working group if it is in conflict with the country's laws and Constitution, and that it can also enter into force without the Constitutional Court's act.
