He is being charged by the Special Prosecutor of the Republic of Kosovo (PSRK), for the murder of a civilian during the recent war in Kosovo, reports “Justice Trust”.
At Wednesday's session, it became known that the lawyer, who has been committed to protecting the accused several days before holding the session, Amman Hoxha, has withdrawn from the defence.
In this regard, accused Shala said lawyer Hoxha, committed to official duty, had given him two letters in which he had told the whole event, following what, according to the accused, the lawyer has no longer agreed to continue his defence.
The same letters were given to the court headed by Judge Raima Elez, special prosecutor Haki Gecaj and the representative of the damaged party, Asdren Hoxha.
In front of lawyer Azman Hoxha, by the defense of the accused, even the lawyer privately committed by Shala, Natal Bulaki,
According to the accused, the reason the lawyers are refusing to offer him protection is because they are afraid.
Since there was no lawyer at Wednesday's session to represent the accused party, the president of the National Lawyers' Oda in Prizren, Hajrep Krasniqi, who, in co-ordination with the accused, appointed the lawyer on official duty, Africa, to represent the accused.
Shortly afterward, the court lawyer, who appeared in the courtroom after consulting with his defense, demanded that this session be interrupted and the same be set for a different date.
The court approved the defense party's request and announced that the next session will be held on October 4, 2020, at 09:30.
Otherwise, the Constitutional Court in Prizren, the Department of Criminal Affairs on July 8th, 2019, had taken on trial with which the accused Shala had convicted him of criminally committing war crimes against the civilian population by being sentenced to 14 years in prison.
But the Court of Appeals has changed the act of first degree, bringing the sentence down to 10 years in prison.
The request for protection of legitimacy in the Supreme Court had submitted the defendant's protector, lawyer Natal Bulaaj, while the State Chief Prosecutor's Office had proposed that the defender's request be denied as unfounded.
And the Supreme Court of the Republic of Kosovo, in May of this year, has turned the case into restoration.
Former Commander The KLA, known as commander “Red Mola”, is charged by the Special Prosecutor of the Republic of Kosovo (PSRK) for killing a civilian during the recent war in Kosovo.
Shala is charged by the Special Prosecutor of the Republic of Kosovo that during wartime in Kosovo, on June 26, 1998, acting as a member of the Kosovo Liberation Army (UÇK), along with several other unidentified members, have taken the victim, Haxhi Perteshi.
According to the indictment, Remzi Shala, who was the only one with no mask on his head, along with 5-6 other KLA members disguised, under suspicion that the deceased was a collaborator of Serbian forces, have gone to the village of Dudhl and the same have been sent to an unknown location.
The victim's son, Agron Pertesh, is said to have seen them leave, along with his father, towards the village of Grejqevc, and after several days the dead man's lifeless body was found near the road, near the centre of the village of Duhdhl.
