This has been announced by the chairman of the court, Judge Bekir Kaluldra, who has said that the court is not in complete shape, because Judge Agim Red is on an annual vacation, reports “Justice Bettim”.
Attending this session were Prosecutor Drita Hajdari and the accused with their defenders, while the defender of the accused Granit Cenaj, lawyer Rame Gashi, who according to the accused is abroad.
Also, the court has ascertained the presence of witness Jemshi Aliu, who was called to give his testimony in this hearing.
In the absence of legal conditions, Judge Kaluldra decided that this session would be postponed on September 11, 2020, at 9:00.
By contrast, Ismet Haliti, Skender Canoli, Blerina Syla, Vehbi Abdullah, Blerim Ibishi, Ardian Muhadri, Arbenita Ajeti, Mergim Shala, Granit Cenaj and Drita Rukiqi are charged that in the position of construction inspectors in Pristina's municipality, during the 2010 yet period, they had not fulfilled official duties under the law.
Two of the accused in this case, Ismet Haliti and Skender Canolli, are also charged with illegal weapons-taking, while for the criminal act of counterfeiting documents, businessman Kemeel Pozheg is also charged, reports the “Justice Betrimy”.
The Constitutional Court in Pristina, on April 20, 2020, the former head of the construction in the Pristina municipality of Ismet Halitin, had sentenced him to 3 years and 6 months in prison for misuse of official office and 1,000 euros in unlicensed weapons penalty.
Under the judgment pronounced by the head of the court, Becir Kalundra, Ismet Halit had also confiscated cars and money in the amount of 11,000 euros, as well as pistols.
Skender Canolli, was found guilty of misuse of office, as well as possession without permission, and was sentenced to 2 years and 6 months in prison, as well as a 1,000-euro fine for illegal possession.
Skender Canoll had also been confiscated, a car called “Passat” and 10,000 Swiss francs.
Inspector Blerina Syla had been sentenced to two years in prison for misuse of office, Vehbi Abdullah, also in two years in prison, Blerim Ibishi to two years, Mergim Shala, for two years and had also confiscated residences in the quarter “Kalabria”, until Drita Rukiqi had been sentenced to 1 year and 6 months, Arbenita Ajeti 1 year and 6 months, Ardian Muhadri with a year in prison, and Granni 1 year in prison.
And businessman Qajel Pozheg was sentenced to 20,000 euros in fines for counterfeiting documents.
Disgusted with the act of first degree, the defence lawyers of all indictees had complained to the Appeals, thus impeaching the Constitutional Court under claims that there are essential violations of the procedural provisions, mistaken confirmation of the actual situation, violation of criminal law, and in connection with the decision of criminal sanctions.
Approval of the defenders ' complaints, in December 2018, the Court of Appeals had annulled the Constitutional Act and turned the subject into retrial.
Otherwise, the Special Prosecutor of the Republic of Kosovo (PSRK) had filed an indictment on June 12th 2015 with the claim that defendants Ismet Haliti, Skender Canoli, Blerina Syla, Vehbi Abdullah, Blerim Ibishi, Ardian Muhadri, Arbena Ajeti, Mergim Shala, Granit Ceny and Drikqiqi, in the position of construction inspectors in Pristina's municipality during the 2010 period, had not met official duties under the law.
The same are accused of not preventing anti-legal construction against investors' facilities Isen Sadiku from the”Hysysi Group”, Ymer Veliu”Naki Trade”, Arber Kryber” Al Petrol”, Bedri Pristina <x6gt> <61>, Chief Recep <x-8> Abix>, Azem Rusofci <x10form> VG Construction” and noble Morina from the <x14 company > ART Group”
The accused, on the other hand, allegedly did not execute the Inspectorate's decisions on the collapse of these objects.
Meanwhile, defendant Kemeil Pozheg, owner of the company “Pozegu Brothers”, is accused of falsification of documents, since the same is alleged to have changed construction permit in order to exploit it as an original document.
