Retrial for the Rahovec assassination, witness relates what he had seen on the critical night

Feriz Hoti is charged with being charged on May 17, 2017, about 2: 00 a.m., in the village of Ratkoc, Rahovec, he has deliberately deprived the late Hamdi Isufi of life now.

He added that after hearing the shots returned from the scene and observed three men dressed in black clothes, running towards the village of Vrajak, reports the “Justice Trust”.

The witness further showed that he saw a person fall from three who were, and then noticed a man dressed in white clothes, but said he didn't remember well after he was 200-300 feet away.

Prosecutor Ali Uka asked the witness if he noticed that guy wearing white guns, but the witness said no.

The Witness showed that the white man had something in his hand, but he does not know what.

Afterward, prosecutor Uka confronted the witness with his testimony from the prosecutor, saying he had seen the white man with a gun in his hand, but witness Morina insisted that he did not know what was in his hand in white clothes.

Afterward, the witness Morina faced the accused, who said he did not resemble the person he saw on the critical night, but added that he knows the accused as a figure.

Judge Guzim Pozheg has appointed 24, 26 and 28 August for holding the next sessions.

Otherwise, the Constitutional Court in Gjakova in September 2018 had released the accused Hoti from charges of murder and illegal weapons without permission or evidence.

And against this ruling, the Court of Appeals had exercised the Basic Prosecution in Gjakova.

Later, the Court of Appeals on May 7th, 2019, has approved the complaint of the Constitutional Prosecutor in Gjakova, thus turning it into retrial and putting the case in question.

According to Apel, the first degree bias should be annulled and in the retrial it must be that for the full proof of the actual situation, witness Bajram Morina's confrontation with the accused Feriz Hoti should be confirmed whether the accused is the man who fired the weapon, because the witness has declared that the site where the event occurred has been enlightened and that he could see whether this person has fired a weapon or not.

According to the indictment, Feriz Hoti is accused of being charged on May 17, 2017, about 2: 00 p.m., in the village of Ratcoc, Rahovec, of life now deprived the late Hamdi Isufi.

He is charged that on the critical night, the late one along with Muhamet Kiqmar, Liridon Sylejmani and Evan Pottera, with the intent of stealing, attempting to break the brandy “Rama F”, property of accused Feriz Hoti, and following the noise caused by the owner, who goes out into the courtyard and a rifle shoots in their direction, where the late Hamdi Isu was shot, who from his injuries died at the scene.

In this case, Feriz Hoti, is accused of committing criminal work “suicide” by Article 178 of the Republic of Kosovo Penal Code (KPRK).

Hoti, also charged that by the critical day, without authorization he possessed weapons type “AK-47”, with what he committed the criminal work “ownership, unauthorized control or possession of weapons” by Article 374, paragraph 1 of KPRK.
