The Special Court has already expired the mandate, which was granted five years ago. How this institution's mandate is continued, there is great uncertainty. But it seems that it cannot be continued without the approval of Kosovo lawmakers. And based on the current mood, it seems impossible.
Based on the amendment to the Kosovo Constitution, under which specialised Chambers and the Office of Kosovo Specialised Prosecutor at The Hague, known as the Special Court or Special Tribunal for War Crimes in Kosovo, the five-year term of this institution has expired.
As a result, it would have to be for the Special Chambers to continue Kosovo's Mancant Assembly, which currently does not seem to have any moods among Kosovo lawmakers. As you know, the Specialised Chambers were created with changing the Constitution, and the continuation of its mandate seems to be only following the same path.
However, in the Law for ratification of international agreements between Kosovo and the European Union, it is said that the mandate of this court will be completed when the European Union Council will announce Kosovo's institutions, which is confirmed in itself.
This fact is referred to in the Special Court, which, although formed five years ago, has not yet filed any war crimes charges.
In June, the Tribunal Prosecution, through a communique for the media, said it has drawn up charges against President Hashim Thaci and Kadri Veselini, PDK chief, for involvement in about 100 murders.
The president has already been interviewed, but the indictment has not yet been confirmed.
Publishing this fact by the Prosecutor, in Pristina, was seen as a political attack rather than an attempt at justice.
Whatever the case, war associations have repeatedly called for this court's mandate not to continue. And the potential accusations against Thaci and Wessel have even turned PDK's deputies into opposition, which five years ago was the main initiator of the establishment of this Tribunal.
Gazeta Express sources say constitutional changes, in the womb of which Tribunali was created, clearly say the mandate is five years old.
The constitution clearly says; the mandate is five years old. Continued mandate could only be made by making constitutional changes again, which require votes of 80 MPs.
The other way seems to be gone.
And is there any mood for continuing the mandate?
Guess not.
The Special Tribunal was founded several years after Senator Dick Marty released his report on Kosovo, in which he accused U leaders. CKE for the macabre killings of Serb and non-Serb civilians and for trafficking with human organs.
The statements have never been confirmed, but publicly the undeclared Kosovo state was severely damaged in the international arena.
