While Kosovo's renowned lawyer, Arianian Koci, has published a post on Facebook account, saying the constitutional amendment, under which the Special Court in The Hague was established, clearly predicts the institution's maximum mandate is 5 years.
This is his full post:
The naive deputies!
The law on ratification of the international agreement between Kosovo and the EU, which has been ratified in the Kosovo Assembly, envisions that the court's mandate will continue until the Union Council informs Kosovo that all investigations and processes under the Specialised Chambers have ended.
On the other hand, the constitutional amendment, under which the Special Court in The Hague has been established, clearly predicts the institution's maximum mandate is 5 years.
In the constitutional amendment, however, there are confusing references and durability, and it is possible that this has been a game of a part of the acts on the part of the international community to ensure the sufficient number of votes of MPs at the time of the special vote.
Of course, the same (nationals) now mean that the mandate continues with automatism.
Our MPs have simply been naive and uncompetive, since they have not long clarified this disagreement.
