Full trial for the conviction of Darko Tasic, indicted for war crimes, published

The Constitutional Court in Prizren has published the indictment, which on 22 June 2020 had convicted accused accused Darko Tasic of war crimes against the civilian population in the village of Krusha e Vogel. To accused Tasic, the court pronounced its unique sentence on 22 years in effective prison, 7 years for plunder, deliberate destruction and cruel assault on human dignity, while another 16 years for the work of serious and cruel assault on personal and human dignity.

The “Justice Vow” has secured the trial, in whose reasoning the facts are presented, evidence of which the court has entrusted the confidence of the guilt and sentence of accused Darko Tasic.

In reasoning of the trial, the court reportedly forgave witness Kasum Hajdari's testimony, Bajram Zylfiu, Kadri Muharremi, Xhafer Muharremi, Drita Batusha, Shaban Avdyli, Gani Zylefiu, Tom Prekpalaj, Dervis Hajdari, Ali Emrullahu, Agron Limani, Dritton Limani, Driton Hajar, Mark Preklaj, Milazi Duraku, Bedri Limani, Fehim Ishmaj, as witness to John Swney, British journalist.

While witness testimony to Qamil Shehu was not taken on the basis of her analysis, as no circumstances under which accused Darko Tasic was directly confirmed.

Also, the guilt and conviction of the accused Tasic is based on British journalist John Sweney's documentary entitled “Reporting of key suspects” and “Witness to murders”, in requests for international legal assistance to The Hague war crimes Tribunal in the former Yugoslavia, confirmed letter and statement by journalist John Sweney given at The Hague Tribunal for the massacre in Kruse Minor.

However, journalist John Shane's written article, the case of Darko Tasic's interrogation in 2017, the defence documentation and authorisation of defenders, for the court did not present any important circumstances that would incriminate Darko Tasic.

The court has assessed and analysed the defence side's claims that the acts of accused Darko Tasic are not criminal acts and are not provided with laws in power and international conventions, viewing them as groundless and unstable.

In the end, the indictment has given the prosecution the right to the parties -- Prosecutor Drita Hajdari -- and accused Darko Tasic and his defenders, lawyers Ljubomir Pantovic and Dejan Vasic -- that if they are unhappy with the indictment, they are eligible in complaints within 15 days, at the Special Department of the Court of Appeals. Otherwise, this case is held on the basis of the SPRK indictment, with which accused Darko Tasic, is charged that during March 1999, he committed war crimes against the civilian population of Krusha e Vogel village of Prizren's municipality.

According to the indictment, Tasic is accused of initially burning houses during the 15th March 1999 period, taking part along with Serbian police and military forces, to plunder and destroy civilian population assets, burning houses, taking in agricultural vehicles and other valuable items of peasants in general, and the Hajdari family in particular. The PSRK Act charges accused Tasic with both desecration of lifeless bodies, burning corpses along with other police and paramilitary forces and throwing corpses into the Drin River, a place outside the village of Krusha e Vogel.

According to the indictment, the accused by his actions has carried out a brutal assault on human dignity and is required to be punished according to the current law by no less than 5 years in prison or long - term imprisonment or by previous law, with no less than 5 years or up to 20 years in effective prison. /Betimi for Justice/
