The five suspects who were arrested in action “Recak II”: Novica Pekinq, Stanoje Janicevich, Borko Paljic, Serdjan Milisavljevic and Stanko Savovic, the Constitutional Court in Pristina has assigned the detention measure.
Under the request of the Special Prosecutor of the Republic of Kosovo for the appointment of the detention measure, the first four suspects are former police of Serbia's Ministry of Internal Affairs (MUP).
In a request provided by the “Justice Vow “, it is said that in the 1998-1999 period, during the war in Kosovo, in the village of Recak, the Development Community, deliberately, in co-ordination, in the quality of members of the Ministry of Home Affairs, known as ♫ ) MUPHA, suspects have seriously violated international law regulations, Article 3 concerning Article 147, of the Geneva Convention of August 12, 1949, and additional protocols I and II of 1977.
This, according to the Prosecutor, the suspects have done by committing murder, inhuman treatment, destruction of property, mass deportation and ethnic cleansing of the Albanian national population who were not involved in war.
Initially, according to the demand, in terms of the killings, it is said that on January 15, 1999, in the village of Recak, the Black Community, the defendants were part of the Serbian police action of police forces, with the cases participating and contributing to the murder of 42 civilians in the village of Recak.
Through their units, it is said that around 0600 a.m. they surrounded the village of Recak, initially promoted it from a distance from several countries known as “Pishhat”, “Gjetan”, “Chesta” and “Guri of Fuum”, then with armoured vehicles, entered the village and began searching for homes.
The request states that in this case, in the courtyard of Rashit Rashitz's home, Banush Camer, who is then beheaded, is first killed. And then, at the place called "Vrellah" Hakki Metush, Saber Syla and Arif Metush.
On the other hand, it is said that in his backyard, Ahmet Mustaf and his neighbour -- Hajriz Jakupi are killed. In the vicinity of the house of Zuk Mustaf, they are killed: Skender Halilin, Hanumshahe Mujota, continues towards the neighborhood of '%Beqaj, and as some civilians head towards the mountain, the Serbian police stand in ambush for them, which without warning shoots at them and kill them: Halim Beqiri, Riza Beqiri and Zenel Beqiri, while left injured Aziz Beqiri, Zuhra Beqiri and Fetije Beqiri.
Always according to the prosecution, in the course of their police and military operation, entered the Eminian Quarter, which was located in the western part of the village where both civilians were wounded on foot by fire in his yard.
Afterwards, according to the prosecution, at the site called CHAeshma '%s' killed civilians Bajram Mehmet, his daughter Hanumshahe Mehmeti, while wounded remained: Elhami Mehmeti, Makfirete Hajrizi, Florije Hajrizi and Hasan Bilalli.
In another part of the village, the prosecution says that from the distance from Ragip Bajram's home and Luta's shop (as villagers call it), they shoot guns of different calibres in the direction of the civilian shelter site, and at this point they kill elderly Nazmi Imer, cruelly breaking his skull, as described in the autopsy report.
P The SRK stresses that from this operation of Serbian police forces, 42 civilians -- of the two genders -- of various ages -- were brutally killed by this operation of Albanian nationality, who were not involved in the war.
At the point of two requirements, torture and inhuman treatment of the civilian population are described. It says that on January 15th 1999, in the village of Recak, defendants high-ranking in the quality of members of Serbian police forces, deliberately and jointly, participated and contributed to the inhuman treatment of about 30 civilians in the village of Recak.
While searching for homes, it is said that some 70 Albanian civilian residents had been sheltered at the home of Sadik Osman in at least two countries.
Furthermore, it is said that about 30-40 police officers entered the backyard, all armed, then under gun threat forced all men out of the shelter and settled in the courtyard, while women and children were locked in the basement, then locked up by keys to the men, lying on the ground, and started to beat inhumanly by using weapons composts, kicks, wood, chains, and other powerful items.
At the point of three, it is about the destruction of civilian population property. It says that Serb military police forces, including the defendants, deliberately and jointly participated and contributed to the destruction of the civilian population of Recak.
Initially, it is said that they surrounded the village of Recak in three directions from places called “Pishat”, “Gjetan” and “Chesta”, then from the distance they promoted it with all military vehicles and finally by armoured vehicles entered the village and searched houses for home.
Then, according to the PSRK, they promoted the distance with all military vehicles and finally by armoured vehicles entered the village and searched houses for homes, so that the sheltered residents took them out of their homes and set their houses on fire by burning down all their homes, crassing all their real estate and playing.
Point four is about the exile of the civilian population. It says that defendants deliberately and jointly participated in and contributed to the expulsion of the civilian population of Recak, who were not involved in the war, so that they first surrounded the village of Recak in three directions from the countries mentioned above, then from the distance they promoted with all military vehicles, then by armoured vehicles entered the village and searched houses for home.
So, according to the request, the sheltered residents were then taken out of their homes, separated by men from women and children, forced by the latter to leave the village, while the forbidden men killed them in the manner described at point 1 of the device, with cases of 20 thousand civilians of Recak village, Topill, Petrov, Krao, Mullapolc, Dremek, were expelled from their homes.
Therefore, the five defendants are suspected to have committed the criminal work “war against the civilian population” sanctioned with Article 142 regarding Article 22 and 30 of the Criminal Law of the former Socialist Republic of Yugoslavia (now RSFJ LP ) as the law in force at the time of the conduct of the criminal act, currently envisioned as “rrim against humanity<3>, sanctioned with Article 143 related to the 31st Criminal Code of the Republic of Kosovo.
