Kosovo's telecom through a communique for the media says it can only save the State Prosecutor and the Government of the Republic of Kosovo, as with a decision by the Constitutional Court in Pristina on July 6th, the reversement of Kosovo's debitor Telekom was rejected and the privat completion order for the amount of financial obligation of around 24.6m euros to Dardafon.net was passed.
With this decision on accelerated final procedure, Telekom says it already risks bankruptcy.
“The consequences of this accelerated completion, in addition to being of social and economic character, will also be of political, national and legal character, as all of this risks erupting as the largest corrupt relationship in the entire history of the Republic of Kosovo”, says among other things in Telekom's response.
Kosovo Telecom's full response:
With a decision by the Constitutional Court in Pristina on the date. 6.07.2020 was rejected by Kosovo's debit Telekom and passed to the private owner the final order for the amount of financial obligation of around 24.6 billion Euros.
With this decision of accelerated end-procedure, unconsidered and deemed enough, Kosovo Telecom is threatened with bankruptcy. While there are opportunities to complain at the Court of Appeals, the same does not necessarily preempt the execution of the final order.
The Dardafon.net company was founded in November 2008 and only two months later, on January 16th 2009, signed with Kosovo Telecom (then PTK) The virtual mobile network operator support agreement. Z-Mobile exploiting over the years the PTK network, receiving benefits in sharing revenues in the 73% report:27%, selling Kosovo Telecom products below price, has competed fairly not only PTK and other operators. Whether because of the unfavourable conditions in the contract or because of the egotistical interest, inflated and peace debts created through a completely suspicious and vague process that should be carefully investigated, Kosovo Telekom was brought into a situation when a virtual company that operated on Kosovo Telecom money is now trying to bankrupt it. From the company's drafted reports of internal experts as well as foreign experts, an assessment has been made that the real losses of Kosovo Telekom, out of this contract appear to be hundreds of millions.
The consequences of this accelerated completion, in addition to being of social and economic character, will also be of political, national and legal character, as all of this risks erupting as the largest corrupt relative in the history of the Republic of Kosovo. Currently, the obstruction of Kosovo's “ringing” depends on the state intervention to stop and cancel the successful conclusion of this publicly suspected corruption process. This process had begun and was carried out with the will of Kosovo's political influential individuals and political boards of PTK/Telekom aimed at depreciating Kosovo Telecom and selling it at any cost, or profit through corporate shares.
The only force that can still and must deal with the preservation of Kosovo's Telekom as national assets has remained the country's Government, which has a legal and constitutional obligation to counter the entire process of robbing Kosovo Telecom and eventually cancel it, returning to the public what is due it.
Consequently, the fate of the once most successful company in the country and the region, which gave the shareholder hundreds of millions of dollars, is now in the hands of the State Prosecutor and the Government of Kosovo.
Therefore, we invite the State Prosecutor to take emergency steps and actions to stop the process of deliberately destroying this national asset, which affects even the foundations of the country's security. Continued delivery of services to state and public institutions, the functional economic chain in relationship with contracting businesses and the security of workers' welfare is a constitutional obligation and must be protected by state justice, not violated and left at the mercy of oligarchs.
Some criminal charges Kosovo Telekom has initiated in the prosecution, indicate sufficient evidence that the 2009 contract (and actions prior to its signing) with Dardafon.net contain elements of the criminal act, which must be followed according to official duty. The execution of this completion should be approved until all legal processes initiated by Kosovo Telecom are completed and connected with the KK commercial report with Dardafon.net. The corporation is reviewing the possibility of the legality of decisions, raising the prosecutor's attention to the issue in question.
Kosovo's telecom has human, professional capacities and has strong will to serve its consumers and to re-generating powerful divides for the shareholder. Even today, against all instructions in its direction, remains the most reliable and preferred bidder of the citizens of the Republic of Kosovo, therefore deserves to be protected, consolidated and empowered.
Kosovo Telecom leaders and employees still remain confident that the Government of the Republic of Kosovo, the State Prosecutor and other state institutions will not allow the bankruptcy of this company to happen. We make public calls for the process of consolidation and restructuring to have full support and inadequate assistance of the shareholder and relevant state institutions.
