Work on establishing the Commercial Court begins

According to the ministerial communiqué, through this bill, the establishment of the Commercial Court, which will be a specialised court divided into two levels (excellent and appeals) with jurisdiction in the entire territory of the Republic of Kosovo, which will be the only address to address the review and the establishment of commercial materials of businesses and other legal persons in Kosovo.
Also, this bill envisions the Commercial Court having its own budget, with a structure of judges and adequate professional staff.
The government of the Republic of Kosovo by 23.03.2020 with the decision no. 04/15, has adopted the concept the Document for Judicial Reform in Contemporary Justice and, therefore, under the Ministry of Justice's legislative programme for 2020, was included in the National Court Bill.
The establishment of such a specialised court is also the recommendation of the process of functional Review of the Law Rule System, the process led by the Ministry of Justice, with widespread involvement of local acts and our strategic partners.
The process of drafting this bill is being supported by the Commercial Justice programme of USAID.
The working Group meeting has been chaired by Deputy Justice Minister Florian Dushi, while there were also: James Haines, federal judge in the United States who has contributed to drafting the original draft of the bill, representatives from the Judiciary Council, as well as other local and international acts.
The justice ministry will commit to the process of drafting and finalising the Bill for the Commercial Court being comprehensive and transparent.
